  1                      A bill to be entitled

  2         An act relating to economic development;

  3         creating the Commission on Intellectual Capital

  4         and Leading Edge Business Development;

  5         providing for membership; providing purposes

  6         and goals; requiring an annual report to the

  7         Legislature; providing for staff and

  8         administrative support; providing an effective

  9         date.

11  Be It Enacted by the Legislature of the State of Florida:

12

13         Section 1.  Commission on Intellectual Capital and

14  Leading Edge Business Development.--

15         (1)  There is created the Commission on Intellectual

16  Capital and Leading Edge Business Development.  The commission

17  shall be administratively housed within the Office of

18  Legislative Services; however, the commission shall not be

19  subject to the control, supervision, or direction of the

20  Office of Legislative Services, except for the purpose of

21  ensuring that the commission is staffed pursuant to this

22  section.

23         (2)(a)  Members of the commission shall consist of the

24  following persons:

25         1.  The chair of the Board of Education or the chair's

26  designee.

27         2.  The chair of the Council for Education Policy

28  Research and Improvement or the chair's designee.

29         3.  The chair of Enterprise Florida, Inc., or the

30  chair's designee.

  1         4.  The chair of Workforce Florida, Inc., or the

  2  chair's designee.

  3         5.  Seven members who are chief executive officers of

  4  existing companies or heads of former companies known for new

  5  initiatives, one of whom is appointed by the Governor, three

  6  of whom are appointed by the President of the Senate, and

  7  three of whom are appointed by the Speaker of the House of

  8  Representatives.

  9         6.  Seven members who are heads of existing venture

10  capital companies, one of whom is appointed by the Governor,

11  three of whom are appointed by the President of the Senate,

12  and three of whom are appointed by the Speaker of the House of

13  Representatives.

14         (b)  All commission members shall be appointed no later

15  than October 1, 2002.

16         (c)  The commission shall meet at least twice a year.

17         (d)  The commission may create and dissolve advisory

18  committees, working groups, and task forces as necessary to

19  carry out the duties and responsibilities of the commission.

20  Such advisory committees, working groups, and task forces may

21  consist of commission members and other persons with knowledge

22  and expertise related to the committee, group, or task force

23  created.

24         (3)  The purposes of the commission shall be to foster

25  and facilitate research and the enhancement of intellectual

26  capital, the promotion of product development and

27  commercialization, and the creation of new companies and

28  expansion of existing companies located within this state to

29  the fullest extent possible.  The emphasis for accountability

30  purposes shall be on the creation of jobs at or above 200

31  percent of the mean income of the counties.  An additional

  1  goal is to ensure that state and local entities responsible

  2  for creating or facilitating the creation of jobs receive, in

  3  a timely manner, reliable and valid information from state and

  4  local entities responsible for research and policy that will

  5  foster and enhance growth in jobs at or above 200 percent of

  6  the mean income.  The commission shall also address the

  7  following, and all related, issues:

  8         (a)  Targeting industrial development in areas of

  9  particular promise for Florida.

10         (b)  Facilitating the collaboration among state

11  universities, state agencies, and the private sector for

12  conducting research and accelerating the transfer and

13  commercialization of technology and intellectual products into

14  the private sector.

15         (c)  Recommending to the Legislature and the State

16  Board of Education funding initiatives to enhance the number

17  of graduates who would enter high-wage sector-strategy jobs

18  and to provide action-oriented programs that enhance

19  university-based or university-affiliated scientific and

20  technical research in areas with the potential to create

21  top-tiered employment in Florida's economy, recruit

22  outstanding university research faculty who have demonstrated

23  expertise and excellence in research, and develop world-class

24  research facilities.

25         (d)  Developing new strategies for Florida's businesses

26  and universities to ensure that appropriate business,

27  financial, and technical assistance is available in the early,

28  high-risk stages of development.

29         (e)  Identifying opportunities and mobilizing state

30  efforts to establish government-supported and

31  private-sector-supported research labs.

  1         (f)  Identifying and reporting to the Commissioner of

  2  Education specific academic and vocational training programs

  3  that produce the skilled workforce necessary for targeted

  4  industries.

  5         (g)  Building strong and long-term partnerships among

  6  worldwide industries, Florida's universities, and career and

  7  technical training programs so that all are strengthened.

  8         (h)  Developing incentive mechanisms and performance

  9  measures for the activities by universities, career and

10  technical training programs, and other government programs

11  that support technology-based industry.

12         (i)  Coordinating commission efforts with Enterprise

13  Florida, Inc., Workforce Florida, Inc., the Agency for

14  Workforce Innovation, the State Board of Education, the

15  Council for Education Policy Research and Improvement, and the

16  state's postsecondary educational institutions.

17         (4)(a)  The commission shall provide to the President

18  of the Senate and the Speaker of the House of Representatives,

19  no later than June 30 each year, beginning in 2003, an annual

20  report of the activities and accomplishments of the

21  commission.

22         (b)  The report shall describe and evaluate the impact

23  of commission and legislative initiatives to promote the

24  development of new technology in this state and shall

25  recommend new or amended initiatives.  The report shall also

26  describe and evaluate existing programs that support small

27  businesses and shall determine whether new programs are needed

28  or existing programs should be improved, consolidated, or

29  organized differently.

30         (5)  The Office of Legislative Services shall contract

31  with the Technological Research and Development Authority to

  1  staff the commission and manage all administration as deemed

  2  necessary and appropriate to carry out the commission's

  3  responsibilities and functions, including preparing the annual

  4  report required pursuant to subsection (4).

  5         Section 2.  This act shall take effect upon becoming a

  6  law.

      Creates the Commission on Intellectual Capital and
11    Leading Edge Business Development as an independent
      entity within the Office of Legislative Services, the
12    primary purpose of which is to foster and facilitate the
      creation, development, and expansion of leading edge
13    businesses in this state in order to produce high-wage
      jobs and boost the state's economy.  See bill for
