13         Amendment to Amendment (740527) (with title amendment) 

14         On page 22, lines 14-27,

15  remove:  all of said lines,

16

17  and insert:  costs and charges which shall be included in the

18  final order or judgment, excluding attorney's fees. This

19  section shall not apply to protests filed by the Office of

20  Supplier Diversity. Upon payment of such costs and reasonable

21  attorney's fees charges by the protestor person protesting the

22  award, the bond, cashier's check, official bank check, or

23  money order shall be returned to the protestor him or her. If,

24  after the completion of the administrative hearing process and

25  any appellate court proceedings, the protestor the person

26  protesting the award prevails, the protestor he or she shall

27  recover from the department, water management district, or

28  agency or water management district, all costs and charges

29  which shall be included in the final order of judgment,

30  excluding attorney's fees.
