  1                      A bill to be entitled

  2         An act relating to trust funds; creating the

  3         Workers' Compensation Administration Trust Fund

  4         within the Department of Business and

  5         Professional Regulation; providing for purposes

  6         and sources of funds; providing for annual

  7         carryforward of fund balances; providing for

  8         future review and termination or re-creation of

  9         the trust fund; providing a contingent

10         effective date.

12  Be It Enacted by the Legislature of the State of Florida:

13

14         Section 1.  Workers' Compensation Administration Trust

15  Fund within the Department of Business and Professional

16  Regulation.--

17         (1)  The Workers' Compensation Administration Trust

18  Fund is created within the Department of Business and

19  Professional Regulation, to be administered by such

20  department.  The trust fund shall be used for the purpose of

21  providing for the payment of all expenses in respect to the

22  administration of the child labor program, pursuant to

23  legislative appropriation or an approved amendment to the

24  department's operating budget pursuant to the provisions of

25  chapter 216, Florida Statutes.

26         (2)  Notwithstanding the provisions of s. 216.301 and

27  pursuant to s. 216.351, Florida Statutes, any balance in the

28  trust fund at the end of any fiscal year shall remain in the

29  trust fund at the end of the year and shall be available for

30  carrying out the purposes of the trust fund.

  1         (3)  Pursuant to the provisions of s. 19(f)(2), Art.

  2  III of the State Constitution, the trust fund shall, unless

  3  terminated sooner, be terminated on July 1, 2006.  Prior to

  4  its scheduled termination, the trust fund shall be reviewed as

  5  provided in s. 215.3206, Florida Statutes.

  6         Section 2.  This act shall take effect July 1, 2002, if

  7  HB 1643 or similar legislation is adopted in the same

  8  legislative session or an extension thereof and becomes law.
