1 A bill to be entitled
2 An act relating to Medicaid services; providing
3 coverage for certain organ-transplant services;
4 amending s. 409.915, F.S.; exempting counties
5 from contributions for such services; providing
6 an effective date.

8 Be It Enacted by the Legislature of the State of Florida:

10 Section 1. Subject to the availability of funds and
11 subject to any limitations or directions provided for in the
12 General Appropriations Act or chapter 216, Florida Statutes,
13 the Agency for Health Care Administration Medicaid program
14 shall pay for medically necessary lung transplant services.
15 Section 2. Subsection (1) of section 409.915, Florida
16 Statutes, is amended to read:
17 409.915 County contributions to Medicaid.--Although
18 the state is responsible for the full portion of the state
19 share of the matching funds required for the Medicaid program,
20 in order to acquire a certain portion of these funds, the
21 state shall charge the counties for certain items of care and
22 service as provided in this section.
23 (1) Each county shall participate in the following
24 items of care and service:
25 (a) For both health maintenance members and
26 fee-for-service beneficiaries, payments for inpatient
27 hospitalization in excess of 10 days, but not in excess of 45
28 days, with the exception of pregnant women and children whose
29 income is in excess of the federal poverty level and who do
30 not participate in the Medicaid medically needy program, and
31 for adult lung transplant services.

1 (b) Payments for nursing home or intermediate
2 facilities care in excess of $170 per month, with the
3 exception of skilled nursing care for children under age 21.
4 Section 3. This act shall take effect July 1, 2002.

9 The CS for SB 2048 requires coverage for lung transplants
under Medicaid, and exempts adult lung transplants from the
10 requirement for county contributions to Medicaid for inpatient
hospitalization.
