1 A bill to be entitled
2 An act relating to Medicaid services; providing
3 a short title; providing coverage for certain
4 organ-transplant services; amending s. 409.915,
5 F.S.; exempting counties from contributions for
6 such services; providing an effective date.

8 Be It Enacted by the Legislature of the State of Florida:

10 Section 1. This act may be cited as the "Jennifer
11 Knight Medicaid Lung Transplant Act."
12 Section 2. Subject to the availability of funds and
13 subject to any limitations or directions provided for in the
14 General Appropriations Act or chapter 216, Florida Statutes,
15 the Agency for Health Care Administration Medicaid program
16 shall pay for medically necessary lung transplant services.
17 Section 3. Subsection (1) of section 409.915, Florida
18 Statutes, is amended to read:
19 409.915 County contributions to Medicaid.--Although
20 the state is responsible for the full portion of the state
21 share of the matching funds required for the Medicaid program,
22 in order to acquire a certain portion of these funds, the
23 state shall charge the counties for certain items of care and
24 service as provided in this section.
25 (1) Each county shall participate in the following
26 items of care and service:
27 (a) For both health maintenance members and
28 fee-for-service beneficiaries, payments for inpatient
29 hospitalization in excess of 10 days, but not in excess of 45
30 days, with the exception of pregnant women and children whose
31 income is in excess of the federal poverty level and who do

1 not participate in the Medicaid medically needy program, and
2 for adult lung transplant services.
3 (b) Payments for nursing home or intermediate
4 facilities care in excess of $170 per month, with the
5 exception of skilled nursing care for children under age 21.
6 Section 4. This act shall take effect July 1, 2002.
