14 On page 1, line 19 through page 2, line 10,
15 remove: all of said lines

17 and insert: Each district court of appeal shall have at least
18 one judge appointed from each judicial circuit within the
19 district who is a resident of the circuit at the time of the
20 original appointment. This requirement is not applicable
21 where the Judicial Nominating Commission for the district
22 court of appeals has advertised a vacancy within an
23 unrepresented circuit and no applications from qualified
24 applicants are received from an unrepresented circuit.
25 Section 2. (1) This act shall not affect the term of
26 any district court of appeal judge who is serving at the time
27 of the effective date of this act or any district court of
28 appeal judgeship which is vacant and awaiting filling by
29 appointment by the Governor at the time of the effective date
30 of this act. Any such judge may be reelected to as many
31 successive terms of office for which the judge may qualify.

1 (2)(a) Upon the retirement, death, removal, or
2 expiration of the term of office without reelection of a judge
3 of a district court of appeal, or upon the creation of an
4 additional judgeship on a district court of appeal, for an
5 appellate district for which there is a judicial circuit from
6 which there is no judge then serving, such vacancy shall be
7 filled only by a qualified resident from the geographical area
8 of such unrepresented judicial circuit if applications are
9 received from qualified applicants within the unrepresented
10 circuit.
11 (b) If at the time of any vacancy on a district court
12 of appeal there is more than one judicial circuit which is
13 unrepresented by a judge on such district court of appeal,
14 such vacancy shall be filled by a qualified resident of the
15 judicial circuit having the lowest judicial circuit
16 designation number if applications are received from qualified
17 applicants within the unrepresented circuit.
