11  The Committee on Health, Aging and Long-Term Care recommended

12  the following amendment:

14         Senate Amendment 

15         On page 25, line 20, through

16            page 26, line 31, delete those lines

17

18  and insert:

19         (b)  Certified prescribed burning pertains only to

20  broadcast burning. It must be conducted in accordance with

21  this section subsection and:

22         1.  May only be accomplished only when a certified

23  prescribed burn manager is present on site with a copy of the

24  prescription from ignition of the burn to its completion.

25         2.  Requires that a written prescription be prepared

26  before receiving authorization to burn from the division.

27         3.  Requires that the specific consent of the landowner

28  or his or her designee be obtained before requesting an

29  authorization.

30         4.  Requires that an authorization to burn be obtained

31  from the division before igniting the burn.

  1         5.  Requires that there be adequate firebreaks at the

  2  burn site and sufficient personnel and firefighting equipment

  3  for the control of the fire.

  4         6.  Is considered to be in the public interest and does

  5  not constitute a public or private nuisance when conducted

  6  under applicable state air pollution statutes and rules.

  7         7.  Is considered to be a property right of the

  8  property owner if vegetative fuels are burned as required in

  9  this subsection.

10         (4)  WILDFIRE HAZARD REDUCTION TREATMENT BURNING BY THE

11  DIVISION.--The division may conduct fuel reduction

12  initiatives, including, but not limited to, burning and

13  mechanical and chemical treatment, on prescribe burn any area

14  of wild land within the state which
