13         Senate Amendment (with title amendment) 

14         On page 18, before line 1,

16  insert:

17         Section 9.  Paragraph (k) is added to subsection (12)

18  of section 403.707, Florida Statutes, to read:

19         403.707  Permits.--

20         (12)  The department shall establish a separate

21  category for solid waste management facilities which accept

22  only construction and demolition debris for disposal or

23  recycling.  The department shall establish a reasonable

24  schedule for existing facilities to comply with this section

25  to avoid undue hardship to such facilities.  However, a

26  permitted solid waste disposal unit which receives a

27  significant amount of waste prior to the compliance deadline

28  established in this schedule shall not be required to be

29  retrofitted with liners or leachate control systems.

30  Facilities accepting materials defined in s. 403.703(17)(b)

31  must implement a groundwater monitoring system adequate to

  1  detect contaminants that may reasonably be expected to result

  2  from such disposal prior to the acceptance of those materials.

  3         (k)  Brazilian pepper and other invasive exotic plant

  4  species as designated by the department resulting from

  5  eradication projects may be processed at permitted

  6  construction and demolition debris recycling facilities or

  7  disposed of at permitted construction and demolition debris

  8  disposal facilities or Class III facilities. The department

  9  may adopt rules to implement this paragraph.
