  1                      A bill to be entitled

  2         An act relating to school system personnel;

  3         creating s. 231.265, F.S.; providing a penalty

  4         for instructional personnel and administrative

  5         personnel who have knowledge of sexual battery

  6         committed by a student upon another student and

  7         fail to report it; providing an effective date.

  9  Be It Enacted by the Legislature of the State of Florida:

10

11         Section 1.  Section 231.265, Florida Statutes, is

12  created to read:

13         231.265  Failure to report certain offenses;

14  penalty.--If any instructional personnel or administrative

15  personnel has knowledge that a sexual battery has been

16  committed by a student upon another student and fails to

17  report the offense to a law enforcement agency having

18  jurisdiction over the school plant, or over the place where

19  the sexual battery occurred if not on the grounds of the

20  school plant, that failure constitutes a misdemeanor of the

21  first degree, punishable as provided in s. 775.082 or s.

22  775.083.

23         Section 2.  This act shall take effect July 1, 2002.

26                          SENATE SUMMARY

27    Makes it a first-degree misdemeanor for school
      instructional personnel or administrative personnel who
28    know of the commission of a sexual battery by a student
      upon another student to fail to report that offense to an
29    appropriate law enforcement agency.
