1 A bill to be entitled
2 An act relating to preferential public contract
3 awards; requiring agencies to give preference
4 to certain companies based in this state in
5 awarding services contracts; providing
6 criteria, requirements, and exceptions;
7 providing an effective date.

9 Be It Enacted by the Legislature of the State of Florida:

11 Section 1. Agencies shall give preference in the award
12 of any contract for services to any proposed contract vendor
13 that has its principal place of employment and operations in
14 this state, hereinafter called a Florida-based company. Such
15 preference shall cause a contract for services to be awarded
16 to a Florida-based company if that company is the only
17 Florida-based company proposing to offer the services
18 requested. If more than one Florida-based company has proposed
19 to offer the services requested, the preference shall apply
20 equally to each Florida-based company and the award shall be
21 made to one of the Florida-based companies prior to making any
22 award to a company that does not meet that criteria. Any
23 request for proposals or invitations to bid between an agency
24 of this state and contract vendors shall include a stated
25 preference for awarding contracts to Florida-based companies.
26 A company is deemed to have its principal base of employment
27 and operations in this state if the company employs more
28 workers in this state than the company employs in any other
29 state. A company seeking to provide services to the state
30 that does not meet this criteria shall be given the same
31 preference for contract awards as a Florida-based company if

1 that company enters into a joint venture relationship with a
2 Florida-based corporate partner to offer the services
3 requested. This preference in contract awards for
4 Florida-based companies or joint ventures including
5 Florida-based companies may only be waived by an agency if
6 there are no contract vendors proposing to offer the services
7 requested that meet the criteria as a Florida-based company
8 and there are no joint ventures proposing to offer the
9 services that have a Florida-based company as one of the joint
10 venture partners.
11 Section 2. This act shall take effect upon becoming a
12 law.
