  1                      A bill to be entitled

  2         An act relating to construction contracts;

  3         requiring a contract for construction of a

  4         residential structure to contain a completion

  5         date and a penalty for failure to timely

  6         complete the structure; providing an effective

  7         date.

  9  Be It Enacted by the Legislature of the State of Florida:

11         Section 1.  Each contract for construction of a

12  structure that will be occupied as a residence must contain a

13  clause that specifies the date on which such occupancy may

14  commence. The clause must include a penalty of at least $1,000

15  for each day by which occupancy is delayed due to the

16  builder's failure to complete the structure by the specified

17  date.

18         Section 2.  This act shall take effect January 1, 2003.
