18 Section 6. Section 373.2505, Florida Statutes, is
19 created to read:
20 373.2505 Permitting requirements for alternative water
21 facilities and electric power plants.--
22 (1) The Legislature finds that the recent increase in
23 proposed electric power plants that are not subject to the
24 regulatory-review requirements of the Florida Electrical Power
25 Plant Siting Act creates both potential problems and
26 water-supply opportunities. The continued proliferation of
27 inland plants may result in environmental and
28 growth-management problems for the counties in which they are
29 located and can affect the patterns of urban development and
30 demands on water resources if improperly located and
31 inadequately regulated.

1 (2)(a) Electric power plants of any generating
2 technology are encouraged to locate in coastal counties where
3 they can be colocated with reverse-osmosis facilities or other
4 similar technologies to desalinate water resources to help
5 meet potable-water-supply needs. Entities having existing
6 electric power plant sites located in coastal counties are
7 encouraged to evaluate modifications, expansions, or additions
8 that would be colocated with reverse-osmosis or other similar
9 technologies to desalinate water resources to help meet
10 potable-water-supply needs.
11 (b) Reverse-osmosis facilities or other similar
12 desalination technologies that are proposed to be colocated
13 with electric power plants are eligible to receive cooperative
14 funding assistance from water management districts created
15 under chapter 373 for those that have cooperative-funding
16 assistance programs for activities designed to promote
17 alternative water supplies.
18 (3) Notwithstanding other permitting requirements
19 imposed by law, construction permit applications for a new
20 electric plant unrelated to an existing electric power plant
21 site located anywhere within the interior counties immediately
22 contiguous to the most impacted area within the Eastern Tampa
23 Bay water caution area must demonstrate that the sole source
24 of its cooling water will be provided by the reuse of
25 reclaimed wastewater or another nonpotable water source in
26 order to assure protection of groundwater and surface water
27 resources.
