11  The Committee on Comprehensive Planning, Local and Military

12  Affairs recommended the following amendment:

13

14         Senate Amendment (with title amendment) 

15         On page 1, lines 3-6, delete those lines

16

17  and insert:

18         Section 3.  Paragraph (d) of subsection (2) and

19  subsection (7) of section 121.052, Florida Statutes, as

20  amended by chapter 2001-262, Laws of Florida, are amended to

21  read:

22         121.052  Membership class of elected officers.--

23         (2)  MEMBERSHIP.--The following holders of elective

24  office, hereinafter referred to as "elected officers," whether

25  assuming elective office by election, reelection, or

26  appointment, are members of the Elected Officers' Class,

27  except as provided in subsection (3):

28         (d)  Any constitutional county elected officer assuming

29  office on or after July 1, 1981, including any sheriff, tax

30  collector, property appraiser, supervisor of elections, clerk

31  of the circuit court, county commissioner, school board

  1  member, or elected school board superintendent, or any elected

  2  officer of any entity with countywide jurisdiction assuming

  3  office on or after July 1, 1981, who, pursuant to general or

  4  special law, exercises powers and duties that, but for such

  5  general or special law, would be exercised by any of the

  6  constitutional county elected officers set forth in this

  7  paragraph, including the sheriff and clerk of the circuit

  8  court in a consolidated government with countywide

  9  jurisdiction unless such sheriff or clerk elected to continue

10  to participate in a local retirement system.

14  And the title is amended as follows:

15         On page 1, line 12, after the semicolon,

16

17  insert:

18         amending s. 121.052, F.S.; revising the

19         membership requirements of the Elected

20         Officers' Class of the system to include

21         certain sheriffs and clerks of the circuit

22         court;
