1 A bill to be entitled
2 An act relating to local-government
3 comprehensive plans; amending s. 163.3177,
4 F.S.; revising the provisions of the recreation
5 and open space element; providing an effective
6 date.

8 Be It Enacted by the Legislature of the State of Florida:

10 Section 1. Paragraph (e) of subsection (6) of section
11 163.3177, Florida Statutes, is amended to read:
12 163.3177 Required and optional elements of
13 comprehensive plan; studies and surveys.--
14 (6) In addition to the requirements of subsections
15 (1)-(5), the comprehensive plan shall include the following
16 elements:
17 (e) A recreation and open space element indicating a
18 comprehensive system of public and private sites for
19 recreation, including, but not limited to, natural
20 reservations, parks and playgrounds, parkways, beaches and
21 public access to beaches, open spaces, and other recreational
22 facilities. Industrial development should not be permitted in
23 areas contiguous to state parks having recreational access to
24 and allowing use of rivers designated as outstanding Florida
25 waterways. Industrial development should be discouraged within
26 5 miles of such state parks.
27 Section 2. This act shall take effect upon becoming a
28 law.
