  1                      A bill to be entitled

  2         An act relating to the rental car surcharge;

  3         amending s. 212.0606, F.S.; providing for a

  4         redistribution of revenues from the rental car

  5         surcharge; providing an effective date.

  7  Be It Enacted by the Legislature of the State of Florida:

  8

  9         Section 1.  Subsection (2) of section 212.0606, Florida

10  Statutes, is amended to read:

11         212.0606  Rental car surcharge.--

12         (2)(a)  Notwithstanding the provisions of section

13  212.20, and less costs of administration, 80 percent of the

14  proceeds of this surcharge shall be deposited in the State

15  Transportation Trust Fund, 15.75 percent of the proceeds of

16  this surcharge shall be deposited in the Tourism Promotional

17  Trust Fund created in s. 288.122, and 4.25 percent of the

18  proceeds of this surcharge shall be deposited in the Florida

19  International Trade and Promotion Trust Fund.  For the

20  purposes of this subsection, "proceeds" of the surcharge means

21  all funds collected and received by the department under this

22  section, including interest and penalties on delinquent

23  surcharges.

24         (b)  Notwithstanding any other provision of law, the

25  proceeds of this surcharge which are deposited in the State

26  Transportation Trust Fund shall be budgeted annually in the

27  Department of Transportation's work program to each department

28  district except the turnpike district. The amount budgeted for

29  each district shall be based upon the amount of the proceeds

30  collected in the counties within each respective district. The

31  district allocations shall be used exclusively to fund the

  1  County Incentive Grant Program for that district as provided

  2  in s. 339.2817.

  3         Section 2.  This act shall take effect upon becoming a

  4  law.
