2 An act relating to transportation grants;
3 amending s. 339.2817, F.S.; authorizing
4 counties to retain or delegate oversight with
5 respect to certain projects under the County
6 Incentive Grant Program; providing an effective
7 date.

9 Be It Enacted by the Legislature of the State of Florida:

11 Section 1. Subsection (6) of section 339.2817, Florida
12 Statutes, is amended to read:
13 339.2817 County Incentive Grant Program.--
14 (6) A municipality may apply to the county in which
15 the municipality is located for consideration by the county
16 for funding under this section of any project or project phase
17 of a transportation facility which is located on the State
18 Highway System or which is demonstrated to relieve congestion
19 on the State Highway System. The county must evaluate all
20 municipal applications as provided in subsection (3). If the
21 proposed project is determined by the county to meet the
22 criteria in subsection (3), the county shall send the
23 application to the department on behalf of the municipality.
24 If the proposed project is then approved by the department,
25 the county may retain project oversight authority and
26 responsibility or delegate the oversight authority and
27 responsibility to the municipality. If a municipality's
28 proposed project is rejected by the county for funding under
29 this section, or if the county's proposed project adversely
30 affects a municipality within the county, the municipality may

1 request mediation to resolve any concerns of the municipality
2 and the county.
3 Section 2. This act shall take effect October 1, 2002.
