9 320.08053, F.S.; amending s. 320.08058, F.S.
10 providing for the creation of the Florida
11 Firefighters license plate; providing for the
12 creation of the Police Benevolent license
13 plate; providing for the distribution of annual
14 use fees received from the sale of such plates;
15 providing an effective date.

17 Be It Enacted by the Legislature of the State of Florida:
18
19 Section 1. Paragraphs (hh) and (ii) are added to
20 subsection (4) of section 320.08056, Florida Statutes, as
21 amended by section 1 of chapter 2001-355, Laws of Florida, to
22 read:
23 320.08056 Specialty license plates.--
24 (4) The following license plate annual use fees shall
25 be collected for the appropriate specialty license plates:
26 (hh) Florida Firefighters license plate, $20.
27 (ii) Police Benevolent Association license plate, $20.
28 Section 2. Subsection (3) of section 320.08058,
29 Florida Statutes, as amended by section 2 of chapter 2001-355,
30 Laws of Florida, is amended, and subsections (34) and (35) are
31 added to that section to read:

1 320.08058 Specialty license plates.--
2 (3) COLLEGIATE LICENSE PLATES.--
3 (a) The department shall develop a collegiate license
4 plate as provided in this section for state and independent
5 universities domiciled in this state. However, any collegiate
6 license plate created or established after October 1, 2002,
7 January 1, 1997, must comply with the requirements of s.
8 320.08053 and be specifically authorized by an act of the
9 Legislature. Collegiate license plates must bear the colors
10 and design approved by the department as appropriate for each
11 state and independent university. The word "Florida" must be
12 stamped across the bottom of the plate in small letters.
13 (b) A collegiate plate annual use fee is to be
14 distributed to the state or independent university foundation
15 designated by the purchaser for deposit in an unrestricted
16 account. The Board of Regents shall require Each state
17 university shall to submit a plan for approval of the
18 expenditure of all funds so designated. These funds may be
19 used only for academic enhancement, including scholarships and
20 private fundraising activities.
21 (34) FLORIDA FIREFIGHTERS LICENSE PLATE.--
22 (a) Notwithstanding the provisions of s. 320.08053,
23 the department shall develop a Florida Firefighters license
24 plate as provided in this section. Florida Firefighters
25 license plates must bear the colors and design approved by the
26 department. The word "Florida" must appear at the top of the
27 plate, and the words "Salutes Firefighters" must appear at the
28 bottom of the plate.
29 (b) The requirements of s. 320.08053 must be met prior
30 to the issuance of the plate. Thereafter, the proceeds of the
31 annual use fee shall be distributed to Florida Firefighters

1 Charities, a 501(c)(3) nonprofit corporation. Florida
2 Firefighters Charities shall distribute the moneys according
3 to its articles of incorporation.
4 (35) POLICE BENEVOLENT ASSOCIATION LICENSE PLATE.--
5 (a) Notwithstanding the provisions of s. 320.08053,
6 the department shall develop a Police Benevolent Association
7 license plate as provided in this section. The word "Florida"
8 must appear at the top of the plate, the words "Support Law
9 Enforcement" must appear at the bottom of the plate, and a
10 shield with the Police Benevolent Association logo must appear
11 to the left of the numerals.
12 (b) The requirements of s. 320.08053 must be met prior
13 to the issuance of the plate. Thereafter, the proceeds of the
14 annual use fee shall be distributed to the Florida Police
15 Benevolent Association Heart Fund, Incorporated, a (510)(c)(3)
16 nonprofit corporation. The Florida Police Benevolent
17 Association Heart Fund, Incorporated, shall distribute moneys
18 according to its articles of incorporation.
19 Section 3. This act shall take effect July 1, 2002.

21 STATEMENT OF SUBSTANTIAL CHANGES CONTAINED IN
COMMITTEE SUBSTITUTE FOR
22 Senate Bill 2162

24 Directs the Department of Highway Safety and Motor Vehicles to
develop two new specialty license plates: (1) the Florida
25 Firefighters license plate and (2) the Police Benevolent
Association license plate. In the case of the Florida
26 Firefighters license plate, net annual use fees are to be
distributed to the Florida Firefighters Charities, Inc. In
27 the case of the Police Benevolent Association license plate,
net annual use fees are to be distributed to the Florida
28 Police Benevolent Association Heart Fund, Inc.
29 Provides that prior to the issuance of these new specialty
plates, the requirements of s. 320.08053, F.S., must be met.

Extends the existing exemption from the specialty license
31 plate requirements for state and independent universities to
October 1, 2002.
