1 A bill to be entitled
2 An act relating to motor vehicle and mobile
3 home titles; amending s. 319.23, F.S.;
4 requiring the Department of Highway Safety and
5 Motor Vehicles to retain certain evidence of
6 titles upon which new titles are issued;
7 providing an effective date.

9 Be It Enacted by the Legislature of the State of Florida:

11 Section 1. Subsections (5) and (11) of section 319.23,
12 Florida Statutes, are amended to read:
13 319.23 Application for, and issuance of, certificate
14 of title.--
15 (5) The certificate of title issued by the department
16 for a motor vehicle or mobile home previously registered
17 outside this state shall give the name of the state or country
18 in which the vehicle was last registered outside this state.
19 The department shall retain the evidence of title presented by
20 the applicant upon which the certificate of title is issued.
21 The department shall use reasonable diligence in ascertaining
22 whether or not the facts in the application are true; and, if
23 satisfied that the applicant is the owner of the motor vehicle
24 or mobile home and that the application is in the proper form,
25 it shall issue a certificate of title.
26 (11) The department is not required to retain any
27 evidence of title presented by the applicant and based on
28 which the certificate of title is issued.
29 Section 2. This act shall take effect July 1, 2002.
