1 A bill to be entitled
2 An act relating to cancer control and research;
3 amending s. 240.5121, F.S., relating to the
4 "Cancer Control and Research Act"; replacing
5 obsolete references to the Board of Regents;
6 providing an effective date.

8 Be It Enacted by the Legislature of the State of Florida:
9
10 Section 1. Paragraph (b) of subsection (3), paragraphs
11 (h), (l), (n), and (o) of subsection (4), paragraphs (a) and
12 (c) of subsection (5), and paragraph (b) of subsection (6) of
13 section 240.5121, Florida Statutes, are amended to read:
14 240.5121 Cancer control and research.--
15 (3) DEFINITIONS.--The following words and phrases when
16 used in this section have, unless the context clearly
17 indicates otherwise, the meanings given to them in this
18 subsection:
19 (b) "Council" means the Florida Cancer Control and
20 Research Advisory Council, which is an advisory body appointed
21 to function on a continuing basis for the study of cancer and
22 which recommends solutions and policy alternatives to the
23 Florida Board of Education Regents and the secretary and which
24 is established by this section.
25 (4) FLORIDA CANCER CONTROL AND RESEARCH ADVISORY
26 COUNCIL; CREATION; COMPOSITION.--
27 (h) The council shall advise the Florida Board of
28 Education Regents, the secretary, and the Legislature with
29 respect to cancer control and research in this state.
30 (l) In order to implement in whole or in part the
31 Florida Cancer Plan, the council shall recommend to the

1 Florida Board of Education Regents or the secretary the
2 awarding of grants and contracts to qualified profit or
3 nonprofit associations or governmental agencies in order to
4 plan, establish, or conduct programs in cancer control or
5 prevention, cancer education and training, and cancer
6 research.
7 (n) The council shall have the responsibility to
8 advise the Florida Board of Education Regents and the
9 secretary on methods of enforcing and implementing laws
10 already enacted and concerned with cancer control, research,
11 and education.
12 (o) The council may recommend to the Florida Board of
13 Education Regents or the secretary rules not inconsistent with
14 law as it may deem necessary for the performance of its duties
15 and the proper administration of this section.
16 (5) RESPONSIBILITIES OF THE FLORIDA BOARD OF EDUCATION
17 REGENTS, THE H. LEE MOFFITT CANCER CENTER AND RESEARCH
18 INSTITUTE, INC., AND THE SECRETARY.--
19 (a) The Florida Board of Education Regents or the
20 secretary, after consultation with the council, shall award
21 grants and contracts to qualified nonprofit associations and
22 governmental agencies in order to plan, establish, or conduct
23 programs in cancer control and prevention, cancer education
24 and training, and cancer research.
25 (c) The Florida Board of Education Regents or the
26 secretary, after consultation with the council, may adopt
27 rules necessary for the implementation of this section.
28 (6) FLORIDA CANCER CONTROL AND RESEARCH FUND.--
29 (b) The fund shall be used exclusively for grants and
30 contracts to qualified nonprofit associations or governmental
31 agencies for the purpose of cancer control and prevention,

1 cancer education and training, cancer research, and all
2 expenses incurred in connection with the administration of
3 this section and the programs funded through the grants and
4 contracts authorized by the Florida Board of Education Regents
5 or the secretary.
6 Section 2. This act shall take effect upon becoming a
7 law.
