1 A bill to be entitled
2 An act relating to trust funds; creating the
3 Entertainment Industry Financial Incentive
4 Trust Fund; providing for sources of funds and
5 purposes; providing for future review and
6 termination or re-creation of the fund;
7 providing a contingent effective date.

9 Be It Enacted by the Legislature of the State of Florida:

11 Section 1. (1) The Entertainment Industry Financial
12 Incentive Trust Fund is created within, and shall be
13 administered by, the Office of Tourism, Trade, and Economic
14 Development. Moneys credited to the fund shall be those
15 appropriated from the General Revenue Fund or from other
16 sources to make incentive payments under Committee Substitute
17 for Senate Bill 2242 or similar legislation creating an
18 entertainment industry financial incentive program. The
19 purpose of the trust fund is to facilitate the payment of
20 incentives under such program.
21 (2) In accordance with Section 19(f)(2), Article III
22 of the State Constitution, the trust fund must, unless
23 terminated sooner, be terminated on July 1, 2006. Before its
24 scheduled termination, the trust fund must be reviewed as
25 provided in section 215.3206(1) and (2), Florida Statutes.
26 Section 2. This act shall take effect on the effective
27 date of Committee Substitute for Senate Bill 2242, or similar
28 legislation, but it shall not take effect unless it is enacted
29 by a three-fifths vote of the membership of each house of the
30 Legislature and unless Committee Substitute for Senate Bill
31 2242, or similar legislation, becomes a law.

4 The committee substitute clarifies that the Entertainment
Industry Financial Incentive Trust Fund is administered by the
5 Office of Tourism, Trade, and Economic Development with
appropriations from the General Revenue Fund or other sources
6 and completes cross-references to Committee Substitute for
Senate Bill 2242, which creates the incentive program that the
7 trust fund will support.
