11  The Committee on Judiciary recommended the following amendment

14         Senate Amendment 
15         On page 1, lines 14-28, delete those lines
16  
17  and insert:  
18         704.08  Cemeteries; right of ingress and egress for
19  visiting or maintenance.--The relatives and descendants of any
20  person buried in a cemetery, and in the absence of such, the
21  members of any not-for-profit organization duly registered
22  with the Division of Historical Resources of the Department of
23  State and whose purposes include the preservation of Florida's
24  history shall have an easement for ingress and egress for the
25  purpose of visiting the cemetery at reasonable times and in a
26  reasonable manner.  The owner of the land may designate the
27  easement.  If the cemetery is abandoned or otherwise not being
28  maintained, such relatives and descendants and in the absence
29  of such, the members of such duly registered not-for-profit
30  organizations may request the owner to provide for reasonable
31  maintenance of the cemetery., and, If the owner refuses or

 1  fails to maintain the cemetery, the relatives, and
 2  descendants, or members of such duly registered organization,
 3  as applicable, shall have the right to maintain the cemetery.
 4         Section 2.  This act shall take effect upon becoming
 5  law.
