11  Senator Clary moved the following amendment:

13         Senate Amendment 

14         On page 107, line 25, through

15            page 108, line 29, delete those lines

16

17  and insert:

18         Section 36.  Subsections (1) and (2) of section 440.24,

19  Florida Statutes, are amended to read:

20         440.24  Enforcement of compensation orders;

21  penalties.--

22         (1)  In case of default by the employer or carrier in

23  the payment of compensation due under any compensation order

24  of a judge of compensation claims or other failure by the

25  employer or carrier to comply with such order within 10 days

26  after the order becomes final, any circuit court of this state

27  within the jurisdiction of which the employer or carrier

28  resides or transacts business shall, upon application by the

29  department division or any beneficiary under such order, have

30  jurisdiction to issue a rule nisi directing such employer or

31  carrier to show cause why a writ of execution, or such other

  1  process as may be necessary to enforce the terms of such

  2  order, shall not be issued, and, unless such cause is shown,

  3  the court shall have jurisdiction to issue a writ of execution

  4  or such other process or final order as may be necessary to

  5  enforce the terms of such order of the judge of compensation

  6  claims.

  7         (2)  In any case where the employer is insured and the

  8  carrier fails to comply with any compensation order of a judge

  9  of compensation claims or court within 10 days after such

10  order becomes final, the division shall notify the department

11  of Insurance of such failure, and the Department of Insurance

12  shall thereupon suspend the license of such carrier to do an

13  insurance business in this state, until such carrier has

14  complied with such order.
