1 A bill to be entitled
2 An act relating to the organization of the
3 Department of Business and Professional
4 Regulation; amending s. 20.165, F.S.; providing
5 for the organization of the Division of Florida
6 Land Sales, Condominiums, and Mobile Homes and
7 the Division of Alcoholic Beverages and
8 Tobacco; prohibiting the transfer of certain
9 funds without prior authorization of the
10 Legislature; providing an effective date.

12 Be It Enacted by the Legislature of the State of Florida:

14 Section 1. Subsections (10), (11), (12), and (13) are
15 added to section 20.165, Florida Statutes, to read:
16 20.165 Department of Business and Professional
17 Regulation.--There is created a Department of Business and
18 Professional Regulation.
19 (10) Any other provision of law to the contrary
20 notwithstanding, the Division of Florida Land Sales,
21 Condominiums, and Mobile Homes shall be organized with at
22 least three bureaus to be known as the Bureau of Condominiums,
23 the Bureau of Timeshare, and the Bureau of Mobile Homes.
24 (11) No more than 10 percent of the moneys deposited
25 in the trust fund of the Division of Florida Land Sales,
26 Condominiums, and Mobile Homes shall be transferred to the
27 office of the secretary or to other parts of the department
28 during any fiscal year without the prior specific
29 authorization by the Legislature in the General Appropriations
30 Act.

1 (12) Any other provision of law to the contrary
2 notwithstanding, the Division of Alcoholic Beverages and
3 Tobacco shall be organized with at least three bureaus to be
4 known as the Bureau of Licensing, the Bureau of Auditing, and
5 the Bureau of Law Enforcement.
6 (13) No more than 10 percent of the moneys deposited
7 in the trust fund of the Division of Alcoholic Beverages and
8 Tobacco shall be transferred to the office of the secretary or
9 to other parts of the department during any fiscal year
10 without the prior specific authorization by the Legislature in
11 the General Appropriations Act.
12 Section 2. This act shall take effect July 1, 2002.

17 The Committee Substitute:
18 -Requires that the Division of Florida Land Sales,
Condominiums, and Mobile Homes be organized with at least
19 three bureaus, the Bureau of Condominiums, the Bureau of
Timeshare, and the Bureau of Mobile Homes, any other provision
20 of law to the contrary notwithstanding.
21 -Requires that the Division of Alcoholic Beverages and Tobacco
be organized with at least three bureaus, the Bureau of
22 Licensing, the Bureau of Auditing, and the Bureau of Law
Enforcement, any other provision of law to the contrary
23 notwithstanding.
24 - Prohibits transfer of more than 10 percent of the moneys
deposited in the trust fund of either division to the office
25 of the secretary or to other parts of the department during
any fiscal year without the prior specific authorization by
26 the Legislature in the General Appropriations Act.
