18 Section 4. Subsection (1) of section 443.1715, Florida
19 Statutes, is amended to read:
20 443.1715 Disclosure of information; confidentiality.--
21 (1) RECORDS AND REPORTS.--Information revealing the
22 employing unit's or individual's identity obtained from the
23 employing unit or from any individual pursuant to the
24 administration of this chapter, and any determination
25 revealing such information, must, except to the extent
26 necessary for the proper presentation of a claim or upon
27 written authorization of the claimant who has a workers'
28 compensation claim pending, must be held confidential and
29 exempt from the provisions of s. 119.07(1) and s. 24(a), Art.
30 I of the State Constitution. Such information may be made
31 available only to public employees in the performance of their

1 public duties, including employees of the Department of
2 Education in obtaining information for the Florida Education
3 and Training Placement Information Program and the Office of
4 Tourism, Trade, and Economic Development in its administration
5 of the qualified defense contractor tax refund program
6 authorized by s. 288.1045 and the qualified target industry
7 tax refund program authorized by s. 288.106. Except as
8 otherwise provided by law, public employees receiving such
9 information must retain the confidentiality of such
10 information. Any claimant, or the claimant's legal
11 representative, at a hearing before an appeals referee or the
12 commission shall be supplied with information from such
13 records to the extent necessary for the proper presentation of
14 her or his claim. Any employee or member of the commission or
15 any employee of the division, or any other person receiving
16 confidential information, who violates any provision of this
17 subsection commits a misdemeanor of the second degree,
18 punishable as provided in s. 775.082 or s. 775.083. However,
19 the division may furnish to any employer copies of any report
20 previously submitted by such employer, upon the request of
21 such employer, and may furnish to any claimant copies of any
22 report previously submitted by such claimant, upon the request
23 of such claimant, and the division is authorized to charge
24 therefor such reasonable fee as the division may by rule
25 prescribe not to exceed the actual reasonable cost of the
26 preparation of such copies. Fees received by the division for
27 copies as provided in this subsection must be deposited to the
28 credit of the Employment Security Administration Trust Fund.
