1 A bill to be entitled
2 An act relating to offenses against public
3 employees and others; amending s. 790.054,
4 F.S.; prohibiting the use of certain
5 self-defense weapons and devices against
6 community service officers, police aides,
7 citizen patrol program members, and traffic
8 officers; amending s. 843.025, F.S.;
9 prohibiting depriving a community service
10 officer, police aide, citizen patrol program
11 member, or traffic officer of a radio or other
12 means of communication; providing penalties;
13 providing an effective date.

15 Be It Enacted by the Legislature of the State of Florida:
16
17 Section 1. Section 790.054, Florida Statutes, is
18 amended to read:
19 790.054 Prohibited use of self-defense weapon or
20 device against law enforcement officer or another;
21 penalties.--A person who knowingly and willfully uses a
22 self-defense chemical spray or a nonlethal stun gun or other
23 nonlethal electric weapon or device or remote stun gun against
24 a law enforcement officer, or a community service officer,
25 police aide, member of a citizen patrol program, or traffic
26 officer who is employed by or volunteering for a county or
27 municipal law enforcement agency or is volunteering for a
28 school board, engaged in the performance of his or her duties
29 commits a felony of the third degree, punishable as provided
30 in s. 775.082, s. 775.083, or s. 775.084.

1 Section 2. Section 843.025, Florida Statutes, is
2 amended to read:
3 843.025 Depriving officer or another of means of
4 protection or communication.--It is unlawful for any person to
5 deprive a law enforcement officer as defined in s. 943.10(1),
6 a correctional officer as defined in s. 943.10(2), or a
7 correctional probation officer as defined in s. 943.10(3) of
8 her or his weapon or radio or to otherwise deprive the officer
9 of the means to defend herself or himself or summon
10 assistance. It is unlawful for any person to deprive a
11 community service officer, police aide, member of a citizen
12 patrol program, or traffic officer who is employed by or
13 volunteering for a county or municipal law enforcement agency
14 or is volunteering for a school board of his or her radio or
15 to otherwise deprive him or her of the means to summon
16 assistance. Any person who violates this section is guilty of
17 a felony of the third degree, punishable as provided in s.
18 775.082, s. 775.083, or s. 775.084.
19 Section 3. This act shall take effect July 1, 2002.

22 SENATE SUMMARY
23 Extends the specific prohibitions against using a
self-defense weapon against a law enforcement officer or
24 depriving a law enforcement officer of a radio or means
of communications to community service officers, police
25 aides, traffic officers, and members of citizen patrols.
