2 An act relating to clinical laboratory
3 personnel; amending ss. 483.805, 483.809,
4 483.811, 483.812, 483.823, F.S.; eliminating
5 obsolete requirements relating to the initial
6 appointments of members to the Board of
7 Clinical Laboratory Personnel; revising
8 regulations relating to the examination,
9 licensure, and qualifications of clinical
10 laboratory personnel; providing an effective
11 date.

13 Be It Enacted by the Legislature of the State of Florida:
14
15 Section 1. Subsection (3) of section 483.805, Florida
16 Statutes, is amended to read:
17 483.805 Board of Clinical Laboratory Personnel.--
18 (3) Within 90 days after July 1, 1992, the Governor
19 shall appoint two members for a term of 2 years, two members
20 for a term of 3 years, and three members for a term of 4
21 years. As terms of the initial members expire, the Governor
22 shall appoint successors for terms of 4 years and such terms
23 shall expire on October 31. A member whose term has expired
24 shall continue to serve on the board until such time as a
25 replacement is appointed. No member shall serve for more than
26 the remaining portion of a previous member's unexpired term,
27 plus two consecutive 4-year terms of the member's own
28 appointment thereafter.
29 Section 2. Subsection (2) of section 483.809, Florida
30 Statutes, is amended to read:

1 483.809 Licensure; examinations; registration of
2 trainees; approval of curricula.--
3 (2) EXAMINATIONS.--The department shall conduct
4 examinations required by board rules to determine in part the
5 qualification of clinical laboratory personnel for licensure.
6 The board by rule shall may designate a national certification
7 examinations examination that may be accepted in part to
8 determine the qualifications lieu of state examination for
9 clinical laboratory personnel or public health scientists.
10 Section 3. Subsection (4) of section 483.811, Florida
11 Statutes, is amended to read:
12 483.811 Approval of laboratory personnel training
13 programs.--
14 (4) The board shall approve training programs for
15 laboratory technicians in a hospital or clinical laboratory
16 which programs are under the supervision of a clinical
17 laboratory director. The training must be accepted in lieu of
18 educational requirements for licensure, but a trainee must
19 have a high school diploma or its equivalent. Any person who
20 completes a training program must pass, before licensure, a
21 national an examination designated by the board under s.
22 483.809 given by the department.
23 Section 4. Subsection (2) of section 483.812, Florida
24 Statutes, is amended to read:
25 483.812 Public health laboratory scientists;
26 licensure.--
27 (2) Applicants at the supervisor level in the category
28 of public health who are certified by the National Registry in
29 Clinical Chemistry or the American Society for Microbiology,
30 licensed as a technologist, and have 5 years of pertinent
31 clinical laboratory experience may qualify by passing a

1 national the state-administered supervision and administration
2 examination designated by the board under s. 483.809.
3 Section 5. Section 483.823, Florida Statutes, is
4 amended to read:
5 483.823 Qualifications of clinical laboratory
6 personnel.--
7 (1) In addition to the requirements of this part, the
8 board shall prescribe, by rule, minimum minimal qualifications
9 of education, training, and experience for clinical laboratory
10 personnel and shall issue a license to any person who meets
11 the minimum qualifications and who demonstrates that she or he
12 possesses the character, training, and ability to qualify in
13 those areas for which the license is sought.
14 (2) A Personnel qualifications may require appropriate
15 education, training, or experience or the passing of an
16 examination in appropriate subjects or any combination of
17 these, but no practitioner of the healing arts licensed to
18 practice in this state is not required to obtain any license
19 under this part or to pay any fee hereunder except the fee
20 required for clinical laboratory licensure.
21 (3) Any supervisor licensed after July 1, 2002:
22 (a) Must have a minimum of a baccalaureate degree in
23 chemical, biological, clinical laboratory science or medical
24 technology from a regionally accredited institution, or an
25 equivalent degree as established by rule of the board, and
26 must have passed a national examination designated by the
27 board under s. 483.809; or
28 (b) For the specialties of cytology or histology, if
29 the supervisor has been practicing continuously since December
30 31, 1984, or earlier, must have an associate degree and must
31 meet any other qualifications set by rule of the board.

1 (4) A clinical laboratory technologist licensed after
2 December 31, 2005:
3 (a) Must have a baccalaureate degree in the area of
4 chemical, biological, clinical laboratory science or medical
5 technology from a regionally accredited institution, or an
6 equivalent degree as established by rule of the board, and
7 must have passed a national examination designated by the
8 board under s. 483.809; or
9 (b) For the specialties of cytology or histology:
10 1. Must have a minimum of a baccalaureate degree, or
11 an equivalent degree as established by rule of the board,
12 which includes 16 semester hours of study of academic science,
13 as defined by rule of the board; or
14 2. If the technologist has been practicing
15 continuously since December 31, 1984, or earlier, must have an
16 associate degree or the equivalent thereof.
17 (5) A clinical laboratory technician licensed after
18 December 31, 2005:
19 (a)1. Must have a general associate degree that
20 includes 8 hours of instruction in academic chemistry and 8
21 hours of instruction in academic biology, or an equivalent
22 degree as established by rule of the board, or an associate
23 degree in medical laboratory technology; and
24 2. Must have passed a national examination designated
25 by the board under s. 483.809; or
26 (b) For the specialty of histology, if the technician
27 has been practicing continuously since December 31, 1984, or
28 earlier, must have a high-school diploma or an equivalent
29 degree.
30 Section 6. This act shall take effect July 1, 2002.
