1 A bill to be entitled
2 An act relating to trust funds; creating the
3 Citizen Donation Trust Fund within the
4 Executive Office of the Governor; requiring
5 that the trust fund be used to receive
6 donations from individuals who wish to support
7 specific programs, activities, or functions of
8 a state agency, school district, state college
9 or university, or other political subdivision
10 of the state; providing that the name of the
11 donor and the designated purpose of the
12 donation are public records; requiring that the
13 Executive Office of the Governor publicize the
14 existence of the trust fund; providing that
15 donations to the trust fund may not replace any
16 appropriation or other allocation of funds to a
17 program or to a state or local governmental
18 agency; requiring the Executive Office of the
19 Governor to adopt rules for distributing moneys
20 from the trust fund to the designated
21 governmental agency; providing a contingent
22 effective date.

24 WHEREAS, the Legislature finds that individuals and
25 groups often believe that the legislative appropriations
26 process results in a distribution of the state's resources in
27 a manner that is inconsistent with the priorities of the
28 individual or group, and
29 WHEREAS, such individuals and groups often express an
30 interest in allocating additional resources to specific

1 activities, programs, school districts, or state and local
2 governmental entities that receive state funds, and
3 WHEREAS, it is the intent of the Legislature to provide
4 a means by which such individuals and groups may donate moneys
5 in support of those activities, programs, school districts, or
6 state and local governmental entities, NOW, THEREFORE,
7
8 Be It Enacted by the Legislature of the State of Florida:
9
10 Section 1. The Citizen Donation Trust Fund.--
11 (1) There is created within the Executive Office of
12 the Governor the Citizen Donation Trust Fund. The purpose of
13 the trust fund is to receive donations from individuals who
14 wish to donate moneys in support of a specific program,
15 activity, or function of a state or local governmental agency,
16 including a school district, state college or university, or
17 any other political subdivision of the state. Each donation to
18 the trust fund is a public record and information concerning
19 the name of the donor and the designated purpose, activity,
20 program, or agency shall be available upon request.
21 (2)(a) The Executive Office of the Governor shall
22 conduct a public-information campaign to publicize the
23 existence and purpose of the trust fund and to provide
24 information to individuals who wish to make a financial
25 donation in support of a state program or agency.
26 (b) Any individual who remits moneys to the trust fund
27 shall specify the purpose, activity, program, or agency to
28 which the donation is designated, and the Executive Office of
29 the Governor shall forward the donation to the appropriate
30 state or local governmental agency.

1 (3) Donations received by the trust fund and allocated
2 to a state or local entity may not be used to supplant or
3 replace any legislative appropriation, allocation, or other
4 disbursement of funds to a program or to a governmental
5 agency, school district, state college or university, or other
6 political subdivision. Each agency receiving moneys from the
7 trust fund shall deposit the moneys into the appropriate
8 account within the agency to be used for the purpose intended
9 by the donor.
10 (4) The Executive Office of the Governor shall
11 establish by rule a process for accounting for donations to
12 the trust fund and for distributing moneys from the trust fund
13 to the designated state or local governmental agency.
14 Section 2. This act shall take effect upon becoming a
15 law, but it shall not take effect unless it is enacted by at
16 least a three-fifths vote of the membership of each house of
17 the Legislature.

20 SENATE SUMMARY
21 Creates the Citizen Donation Trust Fund within the
Executive Office of the Governor. Provides for donations
22 from individuals in support of a state or local
governmental agency, school district, state college or
23 university, or other governmental entity to be deposited
into the fund. Provides that donations to the trust fund
24 are a public record. Prohibits the use of donations to
the trust fund to replace any appropriation to a
25 governmental program or entity. Requires the Executive
Office of the Governor to adopt rules for accounting for
26 donations and distributing moneys from the trust fund.
