1 A bill to be entitled
2 An act relating to state administration;
3 providing a short title; requiring state
4 agencies to propose administrative efficiencies
5 to the Legislature prior to the start of each
6 regular session of the Legislature; requiring
7 state agencies to provide citizens a place on
8 their agency websites for suggesting
9 efficiencies; providing that savings from
10 efficiency recommendations shall be
11 reappropriated to state agencies for salary
12 bonuses; authorizing state agency heads to
13 review and renegotiate contract provisions
14 under certain circumstances and to provide
15 bonuses pursuant thereto; requiring notice,
16 review, and approval of final contract
17 modifications as specified in s. 216.177, F.S.;
18 amending s. 216.134, F.S.; requiring official
19 information developed by each consensus
20 estimating conference to include forecasts for
21 a period of at least 10 years; amending s.
22 216.136, F.S.; requiring the Social Services
23 Estimating Conference to develop official
24 information relating to services to the
25 developmentally disabled; providing an
26 effective date.

28 Be It Enacted by the Legislature of the State of Florida:
29
30 Section 1. This act may be cited as the "Citizen's
31 Government Efficiency Act of 2002."

1 Section 2. State agency efficiency.--
2 (1) All state agency heads shall charge each of their
3 employees with the responsibility of determining ways to make
4 the agency run more efficiently.
5 (2) No later than 45 days prior to the start of each
6 regular session of the Legislature, all state agency heads
7 shall propose statutory or rule changes that would result in
8 savings to their agency's administrative budget. In addition
9 to recommendations from staff, state agency heads shall take
10 into account savings suggestions from citizens and from
11 outside organizations such as Florida TaxWatch, the Florida
12 Council of 100, and the Davis Productivity Awards Foundation.
13 (3) Each state agency website shall contain a place
14 where citizens can make efficiency recommendations. Further,
15 each state agency website shall highlight any efficiency that
16 was enacted by either statutory or rule change.
17 (4) The Legislature shall annually appropriate 10
18 percent of the savings to a state agency from efficiency
19 recommendations back to that agency for salary enhancements.
20 State agencies are encouraged to provide salary bonuses to
21 employees who develop efficiency recommendations.
22 Section 3. State contracts.--
23 (1) All state agency heads are encouraged and
24 authorized to enter into an annual contract review with
25 public-private providers who have entered into multiyear
26 contracts to provide services for the state and to enter into
27 contract renegotiation if it is determined that savings to the
28 state can be obtained. State agency heads are authorized to
29 provide bonuses to public-private providers who provide their
30 services for less than the contract amount, subject to the

1 public-private partners receiving satisfactory performance
2 reviews from those receiving the services.
3 (2) Final contract modifications pursuant to
4 subsection (1) shall be subject to the notice, review, and
5 approval process specified in section 216.177, Florida
6 Statutes.
7 Section 4. Subsection (1) of section 216.134, Florida
8 Statutes, is amended to read:
9 216.134 Consensus estimating conferences; general
10 provisions.--
11 (1) Each consensus estimating conference shall develop
12 such official information within its area of responsibility as
13 the conference determines, by consensus, is needed for
14 purposes of the state planning and budgeting system. Unless
15 otherwise provided by law or decided by unanimous agreement of
16 the principals of the conference, all official information
17 developed by the conference shall be based on the assumption
18 that current law and current administrative practices will
19 remain in effect throughout the period for which the official
20 information is to be used. The official information developed
21 by each consensus estimating conference shall include
22 forecasts for a period of at least 10 years, unless the
23 principals of the conference unanimously agree otherwise.
24 Section 5. Paragraph (a) of subsection (6) of section
25 216.136, Florida Statutes, is amended to read:
26 216.136 Consensus estimating conferences; duties and
27 principals.--
28 (6) SOCIAL SERVICES ESTIMATING CONFERENCE.--
29 (a) Duties.--
30 1. The Social Services Estimating Conference shall
31 develop such official information relating to the social

1 services system of the state, including forecasts of social
2 services caseloads, utilization, and expenditures, as the
3 conference determines is needed for the state planning and
4 budgeting system. Such official information shall include,
5 but not be limited to, cash assistance, services to the
6 developmentally disabled, and Medicaid caseloads.
7 2. The Social Services Estimating Conference shall
8 develop information relating to the Florida Kidcare program,
9 including, but not limited to, outreach impacts, enrollment,
10 caseload, utilization, and expenditure information that the
11 conference determines is needed to plan for and project future
12 budgets and the drawdown of federal matching funds. The
13 agencies required to collect and analyze Florida Kidcare
14 program data under s. 409.8134 shall be participants in the
15 Social Services Estimating Conference for purposes of
16 developing information relating to the Florida Kidcare
17 program.
18 Section 6. This act shall take effect July 1, 2002.
