  2         An act relating to the Florida Electrical Power

  3         Plan Siting Act; amending s. 403.506, F.S.;

  4         expanding application of the act; providing an

  5         effective date.

  7  Be It Enacted by the Legislature of the State of Florida:

  8  

  9         Section 1.  Subsection (1) of section 403.506, Florida

10  Statutes, is amended to read:

11         403.506  Applicability and certification.--

12         (1)  The provisions of this act shall apply to any

13  electrical power plant as defined herein, except that the

14  provisions of this act shall not apply to any electrical power

15  plant or steam generating plant of less than 75 megawatts in

16  capacity or to any substation to be constructed as part of an

17  associated transmission line unless the applicant has elected

18  to apply for certification of such plant or substation under

19  this act. No construction of any new electrical power plant or

20  expansion in steam generating capacity of any existing

21  electrical power plant may be undertaken after October 1,

22  1973, without first obtaining certification in the manner as

23  herein provided, except that this act shall not apply to any

24  such electrical power plant which is presently operating or

25  under construction or which has, upon the effective date of

26  chapter 73-33, Laws of Florida, applied for a permit or

27  certification under requirements in force prior to the

28  effective date of such act. Notwithstanding any provision of

29  law to the contrary, any electrical power plant that uses

30  solely simple-cycle generation and that has 75 megawatts or

31  more in capacity is subject to the provisions of this act.

  1         Section 2.  This act shall take effect October 1, 2002.

  3          STATEMENT OF SUBSTANTIAL CHANGES CONTAINED IN
                       COMMITTEE SUBSTITUTE FOR
  4                             SB 2472

  5                                 

  6  The Committee Substitute deletes all provisions relating to a
    public benefits fund, disclosures from electric utilities, and
  7  clean energy systems. It replaces the provisions on the power
    plant siting act with a provision expanding application of the
  8  act to proposed electrical power plants that use only
    non-steam generation and that are 75 megawatts or more in
  9  capacity. Proposed plants that use some steam generation, but
    less than 75 megawatts, would still be excepted from the
10  siting act.
