  1                      A bill to be entitled

  2         An act relating to health care practitioners;

  3         amending s. 456.001, F.S.; redefining the terms

  4         "license" and "licensee" to include provisional

  5         licenses for purposes of ch. 456, F.S.,

  6         relating to regulation of health care

  7         professions and occupations by the Division of

  8         Medical Quality Assurance of the Department of

  9         Health; repealing ss. 490.00515, 491.0047,

10         F.S., which provide exemptions from the

11         public-records and public-meeting requirements

12         for certain information relating to

13         disciplinary proceedings and treatment programs

14         for impaired practitioners and for meetings

15         wherein such information is discussed;

16         providing an effective date.

18  Be It Enacted by the Legislature of the State of Florida:

19

20         Section 1.  Subsections (5) and (6) of section 456.001,

21  Florida Statutes, are amended to read:

22         456.001  Definitions.--As used in this chapter, the

23  term:

24         (5)  "License" means any permit, registration,

25  certificate, or license, including a provisional license,

26  issued by the department.

27         (6)  "Licensee" means any person or entity issued a

28  permit, registration, certificate, or license, including a

29  provisional license, by the department.

30         Section 2.  Sections 490.00515 and 491.0047, Florida

31  Statutes, are repealed.

  1         Section 3.  This act shall take effect upon becoming a

  2  law.

  5                          SENATE SUMMARY

  6    Redefines the terms "license" and "licensee" to include
      provisional licenses for purposes of ch. 456, F.S.,
  7    relating to health professions and occupations. Repeals
      provisions that provide exemptions from the
  8    public-records and public-meeting requirements for
      certain information relating to disciplinary proceedings
  9    and treatment programs for impaired practitioners and for
      meetings in which such information is discussed.
