  1                      A bill to be entitled

  2         An act relating to consumer services; providing

  3         a penalty for the sale of personal consumer

  4         data without express authorization; providing

  5         an effective date.

  7  Be It Enacted by the Legislature of the State of Florida:

  8

  9         Section 1.  (1)  It is unlawful for any person or

10  business entity to make available, lend, donate, or sell the

11  name, address, account number, or other personal information

12  of any consumer without the express written authorization of

13  that consumer.

14         (2)  Any person who violates this section commits a

15  misdemeanor of the first degree, punishable as provided in

16  section 775.082, Florida Statutes, or section 775.083, Florida

17  Statutes.

18         Section 2.  This act shall take effect July 1, 2002.
