2 A joint resolution proposing an amendment to
3 Section 7 of Article X and the creation of
4 Section 26 of Article XII of the State
5 Constitution relating to casino gambling.

7 Be It Resolved by the Legislature of the State of Florida:

9 That the following amendment to Section 7 of Article X
10 of the State Constitution and the creation of Section 26 of
11 Article XII are agreed to and shall be submitted to the
12 electors of this state for approval or rejection at the next
13 general election or at an earlier special election
14 specifically authorized by law for that purpose:
15 ARTICLE X
16 MISCELLANEOUS
17 SECTION 7. Lotteries.--
18 (a) Lotteries, other than casino gambling as provided
19 in subsection (b) and the types of pari-mutuel pools
20 authorized by law as of the effective date of this
21 constitution, are hereby prohibited in this state.
22 (b) Casino gambling may be conducted within any
23 municipality within a charter county that has a population in
24 excess of a million persons if there is located within the
25 municipality a hotel or commercial lodging facility in excess
26 of 500 rooms and existing pari-mutuel facilities.
27 (c) Tax revenues collected with respect to casino
28 gambling as authorized in this section may be used only to
29 augment the budget of the Department of Elderly Affairs, the
30 Department of Education, and the Department of Children and
31 Family Services.

2 SCHEDULE
3 SECTION 26. Gambling.--The conduct of casino gambling
4 within a municipality as described in Section 7(b) of Article
5 X is subject to the approval of the qualified electors of the
6 county within which the municipality is located voting in a
7 referendum election held for that purpose; however, any
8 municipality in that county may, by local option referendum,
9 reject casino gambling within its corporate limits.
10 BE IT FURTHER RESOLVED that the following statement be
11 placed on the ballot:

14 ARTICLE XII, SECTION 26
15 CASINO GAMBLING.--Proposing an amendment to Section 7
16 of Article X and the creation of Section 26 of Article XII of
17 the State Constitution to permit casino gambling in a
18 municipality within a charter county that has a population in
19 excess of a million if there is in the municipality a hotel or
20 commercial lodging facility in excess of 500 rooms and
21 existing pari-mutuel facilities, and if the electors of the
22 county approve such gambling by referendum, and to provide
23 that the revenues be used to augment the budget of the
24 Department of Elderly Affairs, the Department of Education,
25 and the Department of Children and Family Services.
