1 A bill to be entitled
2 An act relating to Broward County; requiring
3 that licenses and permits for surface water
4 management activities issued by any special
5 district or municipality in Broward County be
6 renewed or recertified every 5 years to ensure
7 design level water quality treatment and flood
8 protection; providing that existing licenses
9 and permits that exceed a 5-year period be
10 brought into compliance; exempting the South
11 Florida Water Management District from the
12 provisions of the act; defining "special
13 district" for purposes of the act; requiring
14 special districts to enact regulations to
15 conform to the act by a specified date;
16 providing for future repeal; providing an
17 effective date.

19 Be It Enacted by the Legislature of the State of Florida:

21 Section 1. (1)(a) Notwithstanding any other law to
22 the contrary, any license or permit for surface water
23 management activities issued by any special district, or any
24 municipality or portion thereof, that is located solely within
25 the boundaries of Broward County shall be renewed or
26 recertified every 5 years. The renewal or recertification
27 shall ensure that the facility for which the license or permit
28 was issued has been maintained in such a way as to meet the
29 level of water quality treatment and flood protection of the
30 original design. In accord with the regulations adopted
31 pursuant to subsection (3), special districts shall bring into

1 compliance any existing licenses or permits that have been
2 issued, recertified, or renewed for a period exceeding 5
3 years.
4 (b) The provisions of this act shall not apply to the
5 South Florida Water Management District.
6 (2) For purposes of this act, "special district" means
7 a district created under, subject to, or otherwise operating
8 pursuant to the provisions of chapter 189, chapter 190, or
9 chapter 298, Florida Statutes, that exercises any general or
10 special powers to license or permit surface water management
11 activities, including authorizing, licensing, or permitting
12 the construction, renovation, or improvement of water
13 management facilities, water control, flood protection, water
14 quantity management, or water quality protection or
15 improvement, or issuing, renewing, or recertifying licenses or
16 permits for any water management activities.
17 (3) All special districts, as defined in subsection
18 (2), shall enact regulations providing for surface water
19 management renewals and recertifications pursuant to this
20 section no later than July 1, 2003.
21 (4) This act expires July 1, 2004.
22 Section 2. This act shall take effect July 1, 2002.
