1 A bill to be entitled
2 An act relating to a public records exemption
3 for certain records held by deepwater ports;
4 amending s. 315.18, F.S., which provides an
5 exemption from public records requirements for
6 any proposal or counterproposal exchanged
7 between a nongovernmental entity and a
8 deepwater port, or any financial records
9 submitted by a nongovernmental entity to a
10 deepwater port, relating to the sale, use, or
11 lease of land or of port facilities; reenacting
12 such exemption and removing the October 2,
13 2002, repeal thereof scheduled under the Open
14 Government Sunset Review Act of 1995; providing
15 an effective date.

17 Be It Enacted by the Legislature of the State of Florida:

19 Section 1. Notwithstanding the October 2, 2002, repeal
20 of said section scheduled pursuant to the Open Government
21 Sunset Review Act of 1995, section 315.18, Florida Statutes,
22 is reenacted and amended to read:
23 315.18 Confidentiality of certain records held by
24 deepwater ports.--Any proposal or counterproposal exchanged
25 between a deepwater port listed in s. 311.09(1) and any
26 nongovernmental entity, relating to the sale, use, or lease of
27 land or of port facilities, and any financial records
28 submitted by any nongovernmental entity to such a deepwater
29 port for the purpose of the sale, use, or lease of land or of
30 port facilities, are confidential and exempt from s. 119.07(1)
31 and s. 24(a), Art. I of the State Constitution. However, 30

1 days before any such proposal or counterproposal is considered
2 for approval by the governing body of such a deepwater port,
3 the proposal or counterproposal shall cease to be exempt. If
4 no proposal or counterproposal is submitted to the governing
5 body for approval, such a proposal or counterproposal shall
6 cease to be exempt 90 days after the cessation of
7 negotiations. This section is subject to the Open Government
8 Sunset Review Act of 1995 in accordance with s. 119.15, and
9 shall stand repealed on October 2, 2002, unless reviewed and
10 saved from repeal through reenactment by the Legislature.
11 Section 2. This act shall take effect October 1, 2002.
