1 A bill to be entitled
2 An act relating to health care practitioners;
3 repealing ss. 490.00515 and 491.0047, F.S.,
4 which provide for application of exemptions
5 from public records and meeting requirements
6 for certain information relating to
7 disciplinary proceedings and to treatment
8 programs for impaired practitioners, and for
9 related probable cause panel proceedings, when
10 the practitioner is a provisional licensee or
11 intern; amending s. 456.001, F.S., revising the
12 definitions of "license" and "licensee" to
13 include provisional licenses for purposes of
14 ch. 456, F.S., relating to regulation of health
15 professions and occupations by the Department
16 of Health; providing an effective date.

18 Be It Enacted by the Legislature of the State of Florida:

20 Section 1. Sections 490.00515 and 491.0047, Florida
21 Statutes, are repealed.
22 Section 2. Subsections (5) and (6) of section 456.001,
23 Florida Statutes, are amended to read:
24 456.001 Definitions.--As used in this chapter, the
25 term:
26 (5) "License" means any permit, registration,
27 certificate, or license, including a provisional license,
28 issued by the department.
29 (6) "Licensee" means any person or entity issued a
30 permit, registration, certificate, or license, including a
31 provisional license, by the department.

1 Section 3. This act shall take effect upon becoming a
2 law.

5 HOUSE SUMMARY

Removes duplicative provisions which provide for
7 application of exemptions from public records and meeting
requirements for certain information relating to
8 disciplinary proceedings and to treatment programs for
impaired practitioners, and for related probable cause
9 panel proceedings, when the practitioner is a provisional
licensee or intern. Revises the definitions of "license"
10 and "licensee" to include provisional licenses for
purposes of ch. 456, F.S., relating to regulation of
11 health professions and occupations by the Department of
Health.
