11  The Committee on Judicial Oversight offered the following:

13         Amendment (with title amendment) 

14         On page 1, line 10 through page 4, line 12,

15  remove:  all of said lines

16

17  and insert:

18         Section 1.  Subparagraph 5. of paragraph (b) of

19  subsection (5) of section 61.075, Florida Statutes, is added

20  to read:

21         (5)  As used in this section:

22         (b)  "Nonmarital assets and liabilities" include:

23         5.  Any liability incurred by forgery or unauthorized

24  signature of one spouse signing the name of the other spouse.

25  Any such liability shall be a nonmarital liability only of the

26  party having committed the forgery or having affixed the

27  unauthorized signature.  In determining an award of attorney's

28  fees and costs pursuant to s. 61.16, the court may consider

29  forgery or unauthorized signatures by a party; and may make a

30  separate award for attorney's fees and costs occasioned by the

31  forgery or unauthorized signature.  This provision shall not
