11  Senator Pruitt moved the following amendment:

13         Senate Amendment (with title amendment) 

14         On page 15, line between lines 24 and 25,

15

16  insert:

17         Section 8.  Subsection (4) is added to section 641.234,

18  Florida Statutes, to read:

19         641.234  Administrative, provider, and management

20  contracts.--

21         (4)(a)  If a health maintenance organization, through a

22  health care risk contract, transfers to any entity the

23  obligations to pay any provider for any claims arising from

24  services provided to or for the benefit of any subscriber of

25  the organization, the health maintenance organization shall

26  remain responsible for any violations of ss. 641,3155,

27  641.3156, and 641.51(4). The provisions of ss.

28  624.418-624.4211 and 641.52 shall apply to any such

29  violations.

30         (b)  As used in this subsection:

31         1.  The term "health care risk contract" means a

  1  contract under which an entity receives compensation in

  2  exchange for providing to the health maintenance organization

  3  a provider network or other services, which may include

  4  administrative services.

  5         2.  The term "entity" does not include any provider or

  6  group practice, as defined in s. 456.053, providing services

  7  under the scope of the license of the provider or the members

  8  of the group practice.

12  And the title is amended as follows:

13         On page 2, line 6, after the semicolon

14

15  insert:

16         amending s. 641.234, F.S.; providing that

17         health maintenance organizations remain liable

18         for certain violations that occur after the

19         transfer of certain financial obligations

20         through health care risk contracts;
