13         Amendment to Amendment (114491) (with title amendment) 

14         On page 148, between lines 21 & 22,

16  insert:

17         Section 126.  Section 458.3461, Florida Statutes, is

18  created to read:

19         458.3461  Health Care Services in Private

20  Residence.--Notwithstanding the provision of ss. 456.053(3)(h)

21  and 456.053(3)(o)3.f., a physician licensed under this chapter

22  may provide health care services to a patient in a patient's

23  private residence. However, this section does not permit a

24  physician to operate a home health agency, unless a home

25  health agency is licensed pursuant to the provisions of

26  chapter 400. For the purposes of this section, the term

27  "private residence" includes a patient's private home,

28  including units owned by a patient in an independent living

29  center and assisted living facility, but does not include a

30  skilled nursing facility.

31         Section 127.  Section 459.027, Florida Statutes, is
