18 Section 80. Section 478.805, Florida Statutes, is
19 amended to read:
20 468.805 Grandfathering.--
21 (1)(a) A person who has practiced orthotics,
22 prosthetics, or pedorthics in this state for the required
23 period between July 1, 1990, and March 1, 1998, who, before
24 March 1, 1998, applied to the department for a license to
25 practice orthotics, prosthetics, or pedorthics, and who
26 received certification in orthotics, prosthetics, or
27 pedorthics from a national certifying body and had his or her
28 application fully approved by the board before October 1,
29 2000, may be licensed as a prosthetist, an orthotist, a
30 prosthetist-orthotist, an orthotic fitter, an orthotic fitter
31 assistant, or a pedorthist, as applicable, without meeting the

1 educational requirements set forth in s. 468.803.
2 (b) The period of experience required for licensure
3 under this subsection is 8 5 years for a prosthetist or an
4 orthotist and 2 years for an orthotic fitter, an orthotic
5 fitter assistant, or a pedorthist. Each applicant shall
6 document experience in the scope of practice for the
7 profession applied for as defined under s. 468.80.
8 (2)(a) An applicant for licensure as an orthotist, a
9 prosthetist, or a prosthetist-orthotist who cannot demonstrate
10 8 5 years of experience as required by subsection (1), but who
11 has practiced as an orthotist, a prosthetist, or a
12 prosthetist-orthotist in this state for at least 2 years
13 between July 1, 1990, and March 1, 1998, and who has received
14 certification as an orthotist, a prosthetist, or a
15 prosthetist-orthotist from a national certifying body before
16 July 1, 1998, is eligible for a provisional license.
17 (b) A provisional licensee is required to practice
18 under supervision of a fully licensed orthotist, prosthetist,
19 or prosthetist-orthotist for up to 3 years in order to meet at
20 least 5-years of the 5-year experience requirement of
21 subsection (1) to be licensed as an orthotist, a prosthetist,
22 or a prosthetist-orthotist. The provisional licensee must
23 demonstrate that the supervised practice includes experience
24 in the scope of practice of the profession as defined under s.
25 468.80.
26 (3) Upon receipt of the nonrefundable application fee
27 and the appropriate licensing fee, the board shall complete an
28 investigation into the applicant's background and experience.
29 The board shall complete its investigation within 6 months
30 after receipt of the completed application. The 90-day period
31 for approval or denial of a license required under s. 120.60

1 does not apply to applications for licensure or provisional
2 licensure under this section.
3 (4) The board by rule shall establish the following
4 fees not to exceed $500 each:
5 (a) Application fee for licensure under subsection
6 (1).
7 (b) Application fee for provisional licensure under
8 subsection (2).
9 (c) Application fee for licensure following
10 provisional licensure under subsection (2).
11 (d) Initial licensure fee.
12 (e) Provisional licensure fee.
13 (5) An applicant who has received certification as an
14 orthotist, a prosthetist, a prosthetist-orthotist, or a
15 pedorthist from a national certifying body which requires the
16 successful completion of an examination, may be licensed under
17 this section without taking an additional examination. An
18 applicant who has not received certification from a national
19 certifying body which requires the successful completion of an
20 examination before March 1, 1998, shall be required to take an
21 examination as determined by the board. This examination shall
22 be designed to determine if the applicant has the minimum
23 qualifications needed to be licensed under this section, and
24 the board may not limit the number of times that an applicant
25 may sit for the examination. The applicant has until July 1,
26 2003, to complete the examination process. The board may
27 charge an examination fee and the actual per applicant cost to
28 the department for purchase or development of the examination.
29 (6) An applicant who successfully completed prior to
30 March 1, 1998, at least one-half of the examination required
31 for national certification and successfully completed the

1 remaining portion of the examination and became certified
2 prior to October 1, 2000, shall be considered as nationally
3 certified by March 1, 1998, for purposes of this section.
4 (7) This section is repealed July 1, 2003.
