11  Senator Diaz de la Portilla moved the following amendment:

13         Senate Amendment (with title amendment) 

14         On page 40, between lines 22 and 23,

15

16  insert:

17         Section 42.  Subsection (1) of section 466.004, Florida

18  Statutes, is amended to read:

19         466.004  Board of Dentistry.--

20         (1)  To carry out the provisions of this chapter, there

21  is created within the department the Board of Dentistry

22  consisting of 11 members who shall be appointed by the

23  Governor and subject to confirmation by the Senate. Seven

24  members of the board must be licensed dentists actively

25  engaged in the clinical practice of dentistry in this state;

26  two members must be licensed dental hygienists actively

27  engaged in the practice of dental hygiene in this state; and

28  the remaining two members must be laypersons who are not, and

29  have never been, dentists, dental hygienists, or members of

30  any closely related profession or occupation. Notwithstanding

31  the provisions of this subsection and s. 20.43(4), the

  1  Governor may appoint as one of the laypersons a dental

  2  laboratory technician who is employed by a registered dental

  3  laboratory. Each member of the board who is a licensed dentist

  4  must have been actively engaged in the practice of dentistry

  5  primarily as a clinical practitioner for at least 5 years

  6  immediately preceding the date of her or his appointment to

  7  the board and must remain primarily in clinical practice

  8  during all subsequent periods of appointment to the board.

  9  Each member of the board who is connected in any way with any

10  dental college or community college must be in compliance with

11  s. 456.007. At least one member of the board must be 60 years

12  of age or older. Members shall be appointed for 4-year terms.
