15 Remove from the bill: Everything after the enacting clause

17 and insert in lieu thereof:
18 Section 1. This act may be cited as the "Officer Scott
19 Baird Act."
20 Section 2. Section 782.07, Florida Statutes, is
21 amended to read:
22 782.07 Manslaughter; aggravated manslaughter of an
23 elderly person or disabled adult; aggravated manslaughter of a
24 child; aggravated manslaughter of a law enforcement officer, a
25 firefighter, an emergency medical technician, or a
26 paramedic.--
27 (1) The killing of a human being by the act,
28 procurement, or culpable negligence of another, without lawful
29 justification according to the provisions of chapter 776 and
30 in cases in which such killing shall not be excusable homicide
31 or murder, according to the provisions of this chapter, is

1 manslaughter, a felony of the second degree, punishable as
2 provided in s. 775.082, s. 775.083, or s. 775.084.
3 (2) A person who causes the death of any elderly
4 person or disabled adult by culpable negligence under s.
5 825.102(3) commits aggravated manslaughter of an elderly
6 person or disabled adult, a felony of the first degree,
7 punishable as provided in s. 775.082, s. 775.083, or s.
8 775.084.
9 (3) A person who causes the death of any person under
10 the age of 18 by culpable negligence under s. 827.03(3)
11 commits aggravated manslaughter of a child, a felony of the
12 first degree, punishable as provided in s. 775.082, s.
13 775.083, or s. 775.084.
14 (4) A person who causes the death, through culpable
15 negligence, of a law enforcement officer as defined in s.
16 943.10(1) or s. 943.10(6), a firefighter as defined in s.
17 112.191, an emergency medical technician as defined in s.
18 401.23, or a paramedic as defined in s. 401.23, while the law
19 enforcement officer, firefighter, emergency medical
20 technician, or paramedic is performing duties that are within
21 the course of his or her employment, commits aggravated
22 manslaughter of a law enforcement officer, a firefighter, an
23 emergency medical technician, or a paramedic, a felony of the
24 first degree, punishable as provided in s. 775.082, s.
25 775.083, or s. 775.084.
26 Section 3. This act shall take effect July 1, 2002.

5 An act relating to manslaughter; amending s.
6 782.07, F.S.; providing that a person who
7 causes the death, through culpable negligence,
8 of a law enforcement officer, a firefighter, an
9 emergency medical technician, or a paramedic
10 while the law enforcement officer, firefighter,
11 emergency medical technician, or paramedic is
12 performing duties of employment commits the
13 offense of aggravated manslaughter; providing
14 an enhanced penalty; providing an effective
15 date.
