  1                      A bill to be entitled

  2         An act relating to education finance; creating

  3         s. 236.08109, F.S.; authorizing school

  4         districts to opt out of the restrictions

  5         applied to allocations for formula-funded

  6         categorical programs and to use such funds at

  7         their discretion; providing an effective date.

  9  Be It Enacted by the Legislature of the State of Florida:

11         Section 1.  Section 236.08109, Florida Statutes, is

12  created to read:

13         236.08109  Local option for categorical funding.--

14         (1)  Notwithstanding s. 236.081 or any other provision

15  of law to the contrary, any school district receiving funds

16  appropriated in the General Appropriations Act for

17  formula-funded categorical programs may, upon request

18  submitted to the Commissioner of Education before the

19  convening of the initial Florida Education Finance Program

20  Appropriation Allocation Conference as provided in s. 236.078,

21  receive those categorical funds in a lump sum and use the

22  funds for any or all of the purposes for which the funds were

23  appropriated or apply the funds to other purposes, as

24  determined by the district school board.

25         Section 2.  This act shall take effect July 1, 2002.
