  1                      A bill to be entitled

  2         An act relating to district school boards;

  3         creating the "Mayra Capote Act"; amending s.

  4         230.23005, F.S.; authorizing district school

  5         boards to prohibit high school students from

  6         leaving the high school campus during lunch

  7         periods; providing an effective date.

  9  Be It Enacted by the Legislature of the State of Florida:

11         Section 1.  This act may be cited as the "Mayra Capote

12  Act."

13         Section 2.  Paragraph (c) of subsection (1) of section

14  230.23005, Florida Statutes, is amended to read:

15         230.23005  Supplemental powers and duties of school

16  board.--The school board may exercise the following

17  supplemental powers and duties. Any provision of chapters 228,

18  229, 231, 232, 233, 234, 235, and this chapter prevails over

19  any conflicting provision of this section. The rules adopted

20  under this section must not be inconsistent with the

21  provisions of chapters 228, 229, 231, 232, 233, 234, 235, and

22  this chapter.

23         (1)  STUDENT MANAGEMENT.--The school board may adopt

24  programs and policies to ensure the safety and welfare of

25  individuals, the student body, and school personnel, which

26  programs and policies may:

27         (c)  Provide procedures for student dismissal

28  precautions and for granting permission for students to leave

29  school grounds during school hours, including releasing a

30  student from school upon request by a parent or guardian or

31  for public appearances of school groups. The school board may

  1  prohibit high school students in the school district from

  2  leaving the high school campus during school lunch periods.

  3         Section 3.  This act shall take effect July 1, 2002.
