  1                      A bill to be entitled

  2         An act relating to commodity procurement;

  3         amending s. 287.012, F.S.; revising a

  4         definition of commodity to include certain

  5         accounting services; providing an effective

  6         date.

  8  Be It Enacted by the Legislature of the State of Florida:

10         Section 1.  Subsection (4) of section 287.012, Florida

11  Statutes, is amended to read:

12         287.012  Definitions.--The following definitions shall

13  apply in this part:

14         (4)  "Commodity" means any of the various supplies,

15  materials, goods, merchandise, food, equipment, and other

16  personal property, including a mobile home, trailer, or other

17  portable structure with floor space of less than 3,000 square

18  feet, purchased, leased, or otherwise contracted for by the

19  state and its agencies.  For the purpose of replacing the

20  state accounting and cash management systems, the term

21  "commodity" includes accounting software and implementation

22  and project management services. "Commodity" also includes

23  interest on deferred-payment commodity contracts approved

24  pursuant to s. 287.063 entered into by an agency for the

25  purchase of other commodities. However, commodities purchased

26  for resale are excluded from this definition. Further, a

27  prescribed drug, medical supply, or device required by a

28  licensed health care provider as a part of providing health

29  services involving examination, diagnosis, treatment,

30  prevention, medical consultation, or administration for

31  clients at the time the service is provided is not considered

  1  to be a "commodity." Printing of publications shall be

  2  considered a commodity when let upon contract pursuant to s.

  3  283.33, whether purchased for resale or not.

  4         Section 2.  This act shall take effect upon becoming a

  5  law.
