2 An act relating to pharmacy; amending s.
3 465.003, F.S.; defining the term "centralized
4 prescription filling"; creating s. 465.0265,
5 F.S.; authorizing centralized prescription
6 filling by one pharmacy for another pharmacy
7 and providing requirements therefor; requiring
8 maintenance of a policy and procedures manual,
9 subject to inspection by the Board of Pharmacy
10 or its agent upon request, and providing
11 requirements therefor; requiring the board to
12 adopt rules to implement the section; providing
13 an effective date.

15 Be It Enacted by the Legislature of the State of Florida:
16
17 Section 1. Subsection (16) is added to section
18 465.003, Florida Statutes, to read:
19 465.003 Definitions.--As used in this chapter, the
20 term:
21 (16) "Centralized prescription filling" means the
22 filling of a prescription by one pharmacy upon request by
23 another pharmacy to fill or refill the prescription. The term
24 includes the performance by one pharmacy for another pharmacy
25 of other pharmacy duties such as drug utilization review,
26 therapeutic drug utilization review, claims adjudication, and
27 the obtaining of refill authorizations.
28 Section 2. Section 465.0265, Florida Statutes, is
29 created to read:
30 465.0265 Centralized prescription filling.--

1 (1) A pharmacy licensed under this chapter may perform
2 centralized prescription filling for another pharmacy,
3 provided that the pharmacies have the same owner or have a
4 written contract specifying the services to be provided by
5 each pharmacy, the responsibilities of each pharmacy, and the
6 manner in which the pharmacies will comply with federal and
7 state laws, rules, and regulations.
8 (2) Each pharmacy performing or contracting for the
9 performance of centralized prescription filling pursuant to
10 this section must maintain a policy and procedures manual,
11 which shall be made available to the board or its agent upon
12 request. The policy and procedures manual shall include the
13 following information:
14 (a) A description of how each pharmacy will comply
15 with federal and state laws, rules, and regulations.
16 (b) The procedure for maintaining appropriate records
17 to identify the pharmacist responsible for dispensing the
18 prescription and counseling the patient.
19 (c) The procedure for tracking the prescription during
20 each stage of the filling and dispensing process.
21 (d) The procedure for identifying on the prescription
22 label all pharmacies involved in filling and dispensing the
23 prescription.
24 (e) The policy and procedure for providing adequate
25 security to protect the confidentiality and integrity of
26 patient information.
27 (f) The procedure to be used by the pharmacy in
28 implementing and operating a quality assurance program
29 designed to objectively and systematically monitor, evaluate,
30 and improve the quality and appropriateness of patient care.

1 (3) The filling of a prescription by one pharmacy for
2 another pharmacy pursuant to this section shall not be
3 construed as the filling of a transferred prescription as set
4 forth in s. 465.026.
5 (4) The board shall adopt rules pursuant to ss.
6 120.536(1) and 120.54 necessary to implement this section.
7 Section 3. This act shall take effect July 1, 2002.
