14 On page 11, between lines 17 and 18,

16 insert:
17 (6)(a) Notwithstanding any other provision of law, no
18 methodology, formula, or database that is that is adopted by
19 rule or policy in any year subsequent to the effective date of
20 this act may result in a distribution to a participating
21 municipality that has a retirement plan pursuant to the
22 provisions of chapter 185 an amount of the insurance premium
23 tax which is less that the amount distributed to such
24 municipality in 2002. If the total proceeds to be distributed
25 from the insurance premium tax imposed under s. 185.08 are
26 less than the amount received in the 2002 calendar year, each
27 municipality shall receive an amount proportionate to the
28 amount it received in the 2002 calendar year. This paragraph
29 is repealed on January 1, 2006.
30 (b) A municipality that receives an insurance premium
31 tax distribution in excess of 200 percent of the tax

1 distribution that such municipality received for the calendar
2 year 1998 is not required to expend for extra pension benefits
3 such portion of its insurance premium tax distribution which
4 exceeds 200 percent of the calendar year 1998 distribution,
5 provided such municipality has met all the minimum pension
6 benefit requirements of chapter 99-1, Laws of Florida. This
7 paragraph is effective only for calendar year 2004 and expires
8 on January 1, 2005.
9 (c) The contrary notwithstanding, beginning January 1,
10 2005, and each calendar year thereafter, each municipality
11 that receives the insurance premium tax and has met all the
12 minimum pension benefits required in chapter 99-1, Laws of
13 Florida, must expend its total annual distribution of such
14 insurance premium tax to provide additional or extra benefits
15 for its police officers. The term "extra or additional
16 benefits" means benefits that are greater than those provided
17 to the general employees of March 12, 1999, and thereafter.
18 (d) The requirements of this subsection do not apply
19 to a municipality that uses its insurance premium tax
20 distribution for supplemental benefits. Furthermore, the
21 Municipal Police and Firefighters Trust Fund Office shall
22 determine the appropriate distribution and shall notify the
23 respective municipality.
