  2         An act providing for the submission of current

  3         information for the preparation of jury lists;

  4         amending s. 40.011, F.S.; requiring the

  5         Department of Highway Safety and Motor Vehicles

  6         to periodically deliver jury lists to the

  7         clerks of circuit courts; amending s. 40.022,

  8         F.S.; requiring the Department of Law

  9         Enforcement to establish procedures for

10         submitting certain information; amending s.

11         322.051, F.S.; requiring applications for

12         identification cards issued by the Department

13         of Highway Safety and Motor Vehicles to specify

14         the county of residence; amending s. 322.08,

15         F.S.; requiring applications for driver's

16         licenses to specify the county of residence;

17         providing an effective date.

19  Be It Enacted by the Legislature of the State of Florida:

20

21         Section 1.  Subsection (1) of section 40.011, Florida

22  Statutes, is amended to read:

23         40.011  Jury lists.--

24         (1)  The Department of Highway Safety and Motor

25  Vehicles shall deliver quarterly to the clerk of the circuit

26  court in each county a list of names of persons who reside in

27  that county, who are citizens of the United States, who are

28  legal residents of Florida, who are 18 years of age or older,

29  and for whom the department has a driver's license or

30  identification card record. On or before January 1, 1993, and

31  each year thereafter by January 1, the Department of Highway

  1  Safety and Motor Vehicles shall deliver to the clerk of the

  2  circuit court in each county a list of names, along with

  3  mailing addresses and dates of birth, of each person 18 years

  4  of age or older whose name appears in the department database

  5  and whose address is in that county. By January 1, 1992, the

  6  department shall begin the process of identifying persons

  7  whose names appear in the department database who are not

  8  citizens of the United States and legal residents of this

  9  state for the purpose of jury selection.  By January 1, 1998,

10  the department database list delivered to the clerk of the

11  circuit court in each county may include only the names of

12  persons who are citizens of the United States and legal

13  residents of Florida and whose address is in that county and

14  who are 18 years of age or older. The clerk of the circuit

15  court shall add to the list the name of any person who is 18

16  years of age or older and who is a citizen of the United

17  States and a legal resident of Florida and who indicates a

18  desire to serve as a juror, but whose name does not appear on

19  the department database list, by requiring such person to

20  execute an affidavit at the office of the clerk.

21         Section 2.  Subsection (4) is added to section 40.422,

22  Florida Statutes, to read:

23         40.022  Clerk to purge jury selection lists;

24  restoration.--

25         (4)  The Department of Law Enforcement shall establish

26  procedures to enable the clerk of the court in each county to

27  submit monthly the names and other identifying information

28  about the persons selected for the jury list. The Department

29  of Law Enforcement will search its databases and return an

30  automated file of matching records that would assist the clerk

  1  in evaluating whether a member of the jury pool should be

  2  disqualified under the provisions of s. 40.013(1).

  3         Section 3.  Subsection (1) of section 322.051, Florida

  4  Statutes, is amended to read:

  5         322.051  Identification cards.--

  6         (1)  Any person who is 12 years of age or older, or any

  7  person who has a disability, regardless of age, who applies

  8  for a disabled parking permit under s. 320.0848, may be issued

  9  an identification card by the department upon completion of an

10  application and payment of an application fee.

11         (a)  Each such application shall include the following

12  information regarding the applicant:

13         1.  Full name (first, middle or maiden, and last),

14  gender, social security card number, county of residence and

15  mailing address, and a brief description.

16         2.  Proof of birth date satisfactory to the department.

17         3.  Proof of identity satisfactory to the department.

18  Such proof must include one of the following unless a driver's

19  license record or identification card record has already been

20  established: a certified copy of a United States birth

21  certificate, a valid United States passport, an alien

22  registration receipt card (green card), an employment

23  authorization card issued by the United States Department of

24  Justice, or proof of nonimmigrant classification provided by

25  the United States Department of Justice, for an original

26  identification card.

27         (b)  An application for an identification card must be

28  signed and verified by the applicant in a format designated by

29  the department before a person authorized to administer oaths.

30  The fee for an identification card is $3, including payment

31  for the color photograph or digital image of the applicant.

  1         Section 4.  Subsection (2) of section 322.08, Florida

  2  Statutes, is amended to read:

  3         322.08  Application for license.--

  4         (2)  Each such application shall include the following

  5  information regarding the applicant:

  6         (a)  Full name (first, middle or maiden, and last),

  7  gender, social security card number, county of residence and

  8  mailing address, and a brief description.

  9         (b)  Proof of birth date satisfactory to the

10  department.

11         (c)  Proof of identity satisfactory to the department.

21         (d)  Whether the applicant has previously been licensed

22  to drive, and, if so, when and by what state, and whether any

23  such license or driving privilege has ever been disqualified,

24  revoked, or suspended, or whether an application has ever been

25  refused, and, if so, the date of and reason for such

26  disqualification, suspension, revocation, or refusal.

27         Section 5.  This act shall take effect October 1, 2002.
