17 Section 1. Paragraph (ee) is added to subsection (3)
18 of section 119.07, Florida Statutes, to read:
19 119.07 Inspection, examination, and duplication of
20 records; exemptions.--
21 (3)
22 (ee) Personal identifying information held by a water,
23 wastewater, natural gas, electric, cable television, or
24 telecommunications utility, owned or operated by an agency,
25 which information identifies a customer of such utility is
26 exempt from subsection (1) and s. 24(a), Art. I of the State
27 Constitution. Personal identifying information includes a
28 customer's name; social security number; taxpayer
29 identification number; address; telephone number; bank account
30 number; debit, charge, and credit card numbers; and driver
31 identification number. This exemption applies to a customer's

1 personal identifying information held by such utility before,
2 on, or after the effective date of this exemption. This
3 paragraph is subject to the Open Government Sunset Review Act
4 of 1995, in accordance with s. 119.15, and shall stand
5 repealed on October 2, 2007, unless reviewed and saved from
6 repeal through reenactment by the Legislature.
7 Section 2. The Legislature finds that it is a public
8 necessity that a customer's social security number; taxpayer
9 identification number; bank account number; and debit, charge,
10 and credit card numbers made exempt by this act be held exempt
11 from public disclosure because such numbers are sensitive,
12 personal information which if released creates the opportunity
13 for identity theft and fraud. Additionally, the social
14 security number is the only nationwide, unique numeric form of
15 identification. Release of a customer's social security
16 number is of concern due to the amount of information such
17 number can provide on an individual. A social security number
18 is often the link to an individual's personal records, whether
19 such records are financial, educational, medical, or familial
20 in nature. Furthermore, the Legislature finds that it is a
21 public necessity that personal identifying information
22 regarding a customer of such utility be held exempt because
23 release of such identifying information creates a competitive
24 disadvantage for an agency owned or operated utility. A
25 private utility is not required by law to disclose any of its
26 customer records to the public.
27 Section 3. This act shall take effect upon becoming a
28 law.
