6 enterprise zones; creating s. 290.00686, F.S.;
7 authorizing the Office of Tourism, Trade, and
8 Economic Development to designate an enterprise
9 zone in Brevard County; providing requirements
10 with respect thereto; authorizing the City of
11 Pensacola to apply to the Office of Tourism,
12 Trade, and Economic Development to designate an
13 enterprise zone in the City of Pensacola;
14 authorizing the office to designate one
15 enterprise zone in the City of Pensacola;
16 providing requirements with respect thereto;
17 authorizing Leon County, or Leon County and the
18 City of Tallahassee jointly, to apply to the
19 Office of Tourism, Trade, and Economic
20 Development to designate an enterprise zone in
21 Leon County; authorizing the office to
22 designate one enterprise zone notwithstanding
23 certain limitations; providing requirements
24 with respect thereto; requiring designation of
25 an enterprise zone in the City of Hialeah under
26 certain circumstances notwithstanding certain
27 limitations; providing requirements with
28 respect thereto; authorizing certain counties
29 to apply for amendment of enterprise zone
30 boundary lines; providing deadlines;
31 prescribing conditions applicable to the areas

1 proposed for addition to the enterprise zone;
2 directing the Office of Tourism, Trade, and
3 Economic Development to approve such amendment
4 under certain conditions; providing
5 application; authorizing the Office of Tourism,
6 Trade, and Economic Development to amend the
7 boundaries of certain enterprise zones;
8 providing limitations; providing an effective
9 date.

11 Be It Enacted by the Legislature of the State of Florida:
12
13 Section 1. Section 290.00675, Florida Statutes, is
14 amended to read:
15 290.00675 Amendment of certain enterprise zone
16 boundaries.--Notwithstanding any other provisions of law, the
17 Office of Tourism, Trade, and Economic Development may amend
18 the boundaries of an area designated as an enterprise zone in
19 a community having a population of 235,000 persons but less
20 than 255,000 245,000, so long as the area does not increase
21 the overall size of the zone by greater than 50 25 acres and
22 the increased area is contiguous to the existing enterprise
23 zone. The amendment must also be consistent with the
24 limitations imposed by s. 290.0055 upon establishment of the
25 enterprise zone.
26 Section 2. Section 290.00686, Florida Statutes, is
27 created to read:
28 290.00686 Enterprise zone designation for Brevard
29 County, Cocoa, or Brevard County and Cocoa.--Brevard County,
30 the City of Cocoa, or Brevard County and the City of Cocoa
31 jointly, may apply to the Office of Tourism, Trade, and

1 Economic Development for designation of one enterprise zone
2 encompassing an area which includes the boundaries of the
3 three community redevelopment areas established pursuant to
4 part III of chapter 163. The application must be submitted by
5 December 31, 2002, and must comply with the requirements of s.
6 290.0055. Notwithstanding the provisions of s. 290.0065
7 limiting the total number of enterprise zones designated and
8 the number of enterprise zones within a population category,
9 the Office of Tourism, Trade, and Economic Development may
10 designate one enterprise zone under this section. The Office
11 of Tourism, Trade, and Economic Development shall establish
12 the initial effective date of the enterprise zone designated
13 pursuant to this section.
14 Section 3. Enterprise zone designation for the City of
15 Pensacola.--The City of Pensacola may apply to the Office of
16 Tourism, Trade, and Economic Development for designation of
17 one enterprise zone within the city, which zone encompasses an
18 area up to 10 contiguous square miles. The application must
19 be submitted by December 31, 2002, and must comply with the
20 requirements of s. 290.0055, Florida Statutes, except
21 subsection (3) thereof. Notwithstanding the provisions of s.
22 290.0065, Florida Statutes, limiting the total number of
23 enterprise zones designated and the number of enterprise zones
24 within a population category, the Office of Tourism, Trade,
25 and Economic Development may designate one enterprise zone
26 under this section. The Office of Tourism, Trade, and Economic
27 Development shall establish the initial effective date of the
28 enterprise zone designated pursuant to this section.
29 Section 4. Enterprise zone designation for Leon
30 County.--Leon County, or Leon County and the City of
31 Tallahassee jointly, may apply to the Office of Tourism,

1 Trade, and Economic Development for designation of one
2 enterprise zone, the selected area of which shall not exceed
3 20 square miles and shall have a continuous boundary, or
4 consist of not more than three noncontiguous areas per s.
5 290.0055(4)(a), Florida Statutes. The enterprise zone shall
6 encompass an area or areas within the following Census tracts
7 for Leon County pursuant to the 1990 Census:

10 census tract 2, block group 3; census tract 2, block group 4;
11 census tract 3, block group 1; census tract 4, block group 1;
12 census tract 4, block group 2; census tract 5, block group 1;

11 The application must be submitted by December 31, 2002, and
12 must comply with the requirements of s. 290.0055, Florida
13 Statutes. Notwithstanding the provisions of s. 290.0065,
14 Florida Statutes, limiting the total number of enterprise
15 zones designated and the number of enterprise zones within a
16 population category, the Office of Tourism, Trade, and
17 Economic Development may designate one enterprise zone under
18 this section. The Office of Tourism, Trade, and Economic
19 Development shall establish the initial effective date of the
20 enterprise zone designated pursuant to this section.
21 Section 5. Notwithstanding the limitation in s.
22 290.0065, Florida Statutes, on numbers of enterprise zones
23 within a population category, the Office of Tourism, Trade,
24 and Economic Development shall designate, upon joint
25 application by Miami-Dade County and the City of Hialeah, an
26 area within the municipality of the City of Hialeah in an area
27 bounded by 32nd Street, 21st Street, Palm Avenue, and East 4th
28 Avenue as an enterprise zone. The application must be
29 submitted by June 1, 2002, and must comply with the
30 requirements of s. 290.0055, Florida Statutes. The effective
31 date of the enterprise zone is July 1, 2002.

1 Section 6. Notwithstanding any provisions in s.
2 290.0055, Florida Statutes, regarding the size of an
3 enterprise zone, a county as defined in s. 125.011(1), Florida
4 Statutes, may apply to the Office of Tourism, Trade, and
5 Economic Development before October 1, 2002, to amend the
6 boundary lines of its existing enterprise zone in order to add
7 an area not exceeding 4 square miles. The area proposed for
8 addition to the enterprise zone under this section must be
9 contiguous to a portion of the existing enterprise zone and
10 must be part of a revitalization area that has been targeted
11 for assistance by the county or by a municipality within the
12 county. The area proposed for addition to the enterprise zone
13 also must contain a high concentration of individuals who have
14 immigrated to this state from Haiti. The Office of Tourism,
15 Trade, and Economic Development shall approve an amendment to
16 the enterprise zone boundary lines, effective January 1, 2003,
17 provided that the area proposed for addition to the enterprise
18 zone is consistent with the criteria and conditions imposed by
19 s. 290.0055, Florida Statutes, upon the establishment of
20 enterprise zones, including the requirement that the area
21 suffer from pervasive poverty, unemployment, and general
22 distress.
23 Section 7. Notwithstanding any provisions in s.
24 290.0055, Florida Statutes, regarding the size of an
25 enterprise zone, a county as defined in s. 125.011(1), Florida
26 Statutes, may apply to the Office of Tourism, Trade, and
27 Economic Development before October 1, 2002, to amend the
28 boundary lines of its existing enterprise zone in order to add
29 an area not exceeding 4 square miles. The area proposed for
30 addition to the enterprise zone under this section must be
31 contiguous to a portion of the existing enterprise zone and

1 must be part of a revitalization area that has been targeted
2 for assistance by the commission authorized in s. 163.065,
3 Florida Statutes. The Office of Tourism, Trade, and Economic
4 Development shall approve an amendment to the enterprise zone
5 boundary lines, effective January 1, 2003, provided that the
6 area proposed for addition to the enterprise zone is
7 consistent with the criteria and conditions imposed by s.
8 290.0055, Florida Statutes, upon the establishment of
9 enterprise zones, including the requirement that the area
10 suffer from pervasive poverty, unemployment, and general
11 distress. The area proposed for addition to the enterprise
12 zone under this section may not include any property used for
13 the benefit of a professional sports franchise. Any portion of
14 the area designated under this section by the Office of
15 Tourism, Trade, and Economic Development as an addition to an
16 enterprise zone shall automatically lose its status as part of
17 an enterprise zone if such portion subsequently includes
18 property used for the benefit of a professional sports
19 franchise.
20 Section 8. Sections of this act authorizing a county
21 as defined in s. 125.011(1), Florida Statutes, to amend and
22 expand the boundary lines of an existing enterprise zone are
23 not mutually exclusive.
24 Section 9. Notwithstanding any other provision of law,
25 the Office of Tourism, Trade, and Economic Development may
26 amend the boundaries of an area designated as an enterprise
27 zone in Manatee County as long as any additional area included
28 within the enterprise zone does not increase the overall size
29 of the enterprise zone by more than 1 square mile and the
30 additional area is contiguous with the existing enterprise
31 zone in such county. An amendment under this section shall be

1 consistent with the limitations imposed by s. 290.0055,
2 Florida Statutes, upon establishment of the enterprise zone.
3 Section 10. This act shall take effect upon becoming a
4 law.
