  1                      A bill to be entitled

  2         An act relating to student withdrawal from

  3         courses due to military service; requiring

  4         rules and policies by district school boards,

  5         community college district boards of trustees,

  6         and university boards of trustees; providing

  7         that a student shall not suffer academic or

  8         financial penalties; authorizing the refund of

  9         fees; providing an effective date.

11  Be It Enacted by the Legislature of the State of Florida:

12  

13         Section 1.  Each district school board, community

14  college district board of trustees, and university board of

15  trustees shall establish, by rule and pursuant to guidelines

16  of the Florida Board of Education, policies regarding

17  currently enrolled students who are called to or enlist in

18  active military service, including members of the National

19  Guard who are called to active service.  Such policies shall

20  provide that any student enrolled in a postsecondary course or

21  courses at an area technical center, a public community

22  college, a public college, or a state university shall not

23  incur academic or financial penalties by virtue of performing

24  military service.  Such student shall be permitted the option

25  of either completing the course or courses at a later date

26  without penalty or withdrawing from the course or courses with

27  a full refund of fees paid.  If the student chooses to

28  withdraw, the student's record shall reflect that the

29  withdrawal is due to active military service.

30         Section 2.  This act shall take effect July 1, 2002.
